Got caught shoplifting at K-Mart and need some help.?

So, it was a $19.99 game from their shelves and it was stupid, I admit it. Anyways, the loss prevention took me to their security room and took my ID and started taking down info. They said it was their policy to get the police involved and there was a chance they'd take me to jail that day, but when the cop showed up he just let me go. So, the loss prevention guys said that I would be receiving a thing in the mail from K-Mart's attorneys because they will sue me for restitution and other things, but the officer said I would also receive something to appear in court. Everything else I've read about shoplifting from K-Mart has said that if K-Mart sends something about fines, that that is an out of court settlement and I won't have to go to court. I'm just really worried and I wanted to know what the most likely path that this is going to follow. Useful info: I'm 19, it's my first offense, and I live in Indiana.

First off, I'm amazed that you were able to find a K-Mart.

Second, I'm amazed that you chose that store to steal from. Wasn't Target open?

Third, you can expect to be sued in civil court by K-Mart. They will ask for court costs, fees, fines, penalties, etc. Expect to pay between $300 and $1,500 in "restitution". If you pay the amount prior to court, you won't have to go. If you choose to fight it, you'll need an attorney and will need to appear at the hearing.

The officer's comment means you'll be receiving notice to appear in CIVIL court to address the lawsuit by K-Mart.

Also expect to be banned from K-Mart for a while.

you'll have to pay a fine to k-mart and get a court summons from the police. maybe you should have paid the $19.99 because now it's going to cost you about $1,000.00. like you said, you were really stupid.

Kmart is one of those stores that goes full throttle after shop lifters. You will get a fine and probation. No jail time. But this charge will follow you around the rest of your life, meaning you won't be getting any good job when the time comes you decide to be a responsible adult. I'd suggest going to college and doing extremely well to supersede this dumb mistake.

By shoplifting, you actually committed two separate offenses. You violated state criminal law, and you violated Kmart civilly by taking something that was not yours. You can legally be held responsible for both.

What the security guard is talking about is called a civil demand. They can sue you for not only the cost of the item, but for reasonable court costs.

However, it sounds like the officer is also going to send you a summons to appear. Although you can settle out of court for the civil demand, you still have to appear in court for the state law violation.

They're probably just trying to scare you, it seems ridiculous to sue you for that and it's your first offense, I don't think it'll go any further.

I was 16 when I got caught shoplifting at k mart. I had never been in trouble before. The cops were called and I was handcuffed in the store and placed under arrest. 3 weeks later I got a fine in the mail for 250.00 dollars. About a monto later I got a paper in the mail saying I had to appear in court. In 8 months time I had 5 court dates and then was put on probation/court supervision. Then I was ordered 25 hours of community service. You were really lucky to have not been arrested. The cops said if I would've been 17 I would have gone to jail :( it's good you didn't.
