HELP, THIS IS AN EMERGENCY?

Ok, my boyfriend's parents claimed that they filed something saying I can't leave the state with my child and that someone should have been by my house serving me papers Friday afternoon but I never got anything. And I didn't get anything today either. I am really scared and I need to get away from here. I live in Kentucky and my question is I know that they can serve you papers but can they serve you only at your residence or anywhere?

any papers served have to be put in your hand by a legal server....sounds like your good to go

Until an officer of the court puts that paper into your hands, you have not been served. You are good to go. Keep in mind, when and if you return, you will probably face more legal action.

Couple of thoughts here...I am not a lawyer so treat what I say accordingly.
1) is there a Legal Aid society in your area? If so contact them. If you have the resources consult an attorney. also check for any county run family assistance programs. you will get much advice from them

2) What role would your boyfriends parents have in serving you with papers. I am not aware of grand parents having any 'Rights' as far as children go.

3) In Your shoes..(you do not specify why you are scared) if I was seriously concerned about my safety I would leave town then find legal assistance in whatever safe place I found.

Well you need a lawyers advice because people like me can only give you a good guess or share a personal experience with you

But as far as I understand "they" need to stick the papers in your hand OR in the hand of an adult who lives at your official or principle residence but you can be served any where -- clearly your house is the best place to find you

Then they have to go back to the courts and fill out a form that says I swear as an officer of the court I gave it to Jane Smith on or about the 2nd day of April etc etc

But in cases like this you do not want to hope I am right or that the law in my Canadian Province is more or less the same as your State -- so you want to go to a lawyer


Take the papers -- if they give them to you -- It is not the end of the story --

But in order to fight - or understand what the papers really say --- get a lawyer

I hope I am being clear enough -- Find a lawyer

To answer your question you can be served any where. I have to add though that the boys parents can say whatever they want - doesn't make it true. Present yourself to the court. Win/win. You showed a willingness to cooperate with the court and do what is best for your child (They were gonna find you eventually anyway) / His parents may be trying to manipulate you, there is no order, and you don't have that to worry about

Go to the local courthouse on your own and find out if there are any papers from family court that are supposed to be served upon you. The court should have a record of it. If they got a lawyer, they may have had a process server looking to give you the papers. However, if no lawyer is involved yet,then maybe the local sheriff's office would look to serve papers to you. For one, go to your local child support enforcement bureau and inform them that you would like to file for child support. Give them all the information on your childs father that you have. When it comes time to go to court, they will have a lawyer from child support, free of charge, help you with the child support and any other issues including this baloney about you not being able to leave the jurisdiction. Are you over 18? Start asserting yourself because it sounds like your boyfriends parents are minding your business and NOT THEIR OWN. You didn't say if your boyfriend is backing them up. If that is the case, get going and assert yourself.! Good Luck!

Yea they can serve you anywhere. They're going to try your house a few more times before going to your work or wherever.
