depends on the case, may have been fined lost licence etc, he would only be walking free if got found not guilty, the judge gave him the penalty he deserved you'll have to ask him or look in paper as to what happened! |

I remember years ago a man ran over someone he was hit so hard he came through the car windscreen, the driver then took him to a multi story car park and left him to die.
When caught the man was charged with driving with no license and insurance and was given a 6 month sentence. |

Yes. In england, drunk driving is not treated seriously unless a police officer is hurt.
But it is not just drunks. My sister was beaten up in another town by four thugs for their personal enjoyment. She had to go there under the threat of imprisonment. After the trial she had to walk back to the station despite the fact that the yobs who gave her stitches on her head were allowed to leave court at the same time. Her agoraphobia is improving slowly.

If drugs or alcohol was not involved, most likely there will just be a fine. Accidents happen, even when speeding is involved they will probably get probation. |

Vehicular Homicide, or Manslaughter w/vehicle. While my intent is not to compound your injury and pain, the Law states that if a person is not aware that they are committing a crime they cannot be charged. Temporary Insanity, or Diminished Capacity are quite common in cases such as this.

My cousin died in a car crash when he got into a friends car. His friend then started racing with another on the road, lost control and crashed into a tree. My cousin bore the impact and died instantly whilst she got cuts and bruises, she too was charged with causing death by dangerous driving. Her sentence? 6 points, 3yr driving ban and a £1,500. fine. Makes you sick doesn't it to think that a 22yr olds life was worth only that. |

yes when younger lost three friend due to drunk driver drunk t-boned them at 4-way stop police said doing at least 80mph three werenot drinking drunk driver got off with 300.00 fine lose of license for 12 months probation for 6. of course his family had mega bucks and good friend of judge |

You have to know your state's traffic laws and the situation at hand in order to answer that question. In Texas the fines and penalties are doubled if you're convicted of speeding or reckless driving in a construction zone when workers are present. Don't know about whatever state this event was in. Look up the traffic laws there. Each state is different. |

Yes, there was that 76 year old man (who just happens to be the multi-millionaire son of the Burtons clothing range) who killed someone a few years ago, he was released because it was 'automated driving' where his brain had just sort of blanked out for a while. |

a girl i went to school with was killed in a hit and run she was hit at 95 mph and died later that night in hospital the driver was pulled by police earlier that night and found to be over the drink limit he was stopped again after and found to be so intoxicated he could hardly stand up yet he was released went home and handed himself in 6 weeks later to the police after getting his car fixed he got 2 years suspended and banned from driving for 3 years and court costs |

Yes, but many police officers haven't even gone though the court procedure when they kill someone, due to their own dangerous driving while on duty.
Sorry never realized it was an actual case, until I saw your additional details.
You shouldn't have anything to worry about, even if you had reported the person, just be cautious, it wasn't you who did the dangerous driving. |

yeah there are plenty of death by dangerous driving cases where the offender has recieved a suspended sentance and community order rather than jail. |

Yes I have known it to happen most recently about 5 weeks ago at Leeds Crown Court.
However this was a jury decision....so one can only ever blame the general public. The case was well presented for the Prosecution, but the jury had sufficient doubt to acquit.
Its a sad state of affairs for the family and friends of the deceased, but thats the very reason why we have trial by jury. |

I supervised someone on license for the death of his close friend while he was driving drunk, he had gotten 3 years.
On this occasion I am not convinced that the prison sentence compares to the burden that he has to bear of knowing he ended the life of his friend. |
