Help with Illegal Search and Seizures and the Fourth Amendment?

Could someone please explain this confusing question to me as to the search and seiaure laws? I also need to know how the Fourth Amendment would play into this situation?
During a warrant less search of a defendant’s apartment, the police find a letter indicating that the defendant, John Smith, keeps the drugs he sells in a closet in his mother’s house. On the basis of the letter, a magistrate issues a search warrant for Smith's mother’s house, and the police search reveals drugs in the closet. In your opinion, should the drugs be admissible at Smith’s trial for possession of drugs with intent to deliver? Give reasons in support of your answer.
I am not sure about the question of the drugs being admissisble because a magistrate issued the warrant for the mothers home and I am also not sure they could have legally serched the John Smith home without a warrant and take a letter to a magistrate to obtain a warrant
Help please someone with background and knowledge on this subject

If the had a lawful reason to search the first apartment (any violation of the law could give them the right).Also if they ask and he says ok ,thinking they wouldn't find anything.
After that anything they find can be used to gather further info or be used in court to get the warrants . |
