Going to court to ask for a protection order (sometimes called a restraining order, a civil protection order, or various types of injunctions) is part of the civil court process.

Go to the Clerk's Office at the courthouse in your community and fill out the papers. This usually consists of a form called a petition that you'll fill out - telling the judge how you've been harmed, physically, emotionally or otherwise. You don't need to go into a lot of background as to what led up to the abuse, just be simple and clear - saying exactly what happened and when. Be sure to include if there have been threats or if you or your children have been harmed or scared. If you've ever called the police because of an incident with your abuser, it's important that you put in that information. Once you've finished your petition, someone in the Clerk's office will need to notarize it - so be sure to have photo ID with you.

If you feel threatened or are being stalked you need to file a police report...then talk to the officers about the restraining order...you have to have some kind of documentation of the abuse...

Try going to your local State Attorney's Office. Bring any proof of any domestic violence or such that you have. Don't get your hopes up on getting the order though. I've heard conflicting stories before down in Lee County-have to have 3 documented proof of violence etc. etc. But see what they have to say about your case.

If your ex is still living with you or still has her address there, and has assaulted or physicallt threatened you then what Shelley & Reesie said. Fla. is one of the states where you can get a domestic restraining order by going to the court clerk's office yourself. Theye are required to assist with domestic orders & have forms for doing so.

If your ex never lived with you or moved out long ago, or is just annoying rather than physically threatening, then you're on your own & will probably need a lawyers' help in obtaining a standard type of restraining order.

i'm not certain of the exact procedure in Florida, but where I live your first step is to get an appointment at the domestic abuse service center for the county where you live. The intake worker will interview you and fill out the court petition to ask the judge to approve the restrianing order or OFP, "order for protection". You will have to know the dates and details of each recent incident of abuse and also the home or work location of the person you want the order against. if you have any police call/911 calls documentation, bring those with you as well.
If the judge signs your petition, then you have a temporary ex -parte order in effect and the sheriff will serve the papers on the person who the order is against.

The person you filed against can contest the OFP and ask for a court date to refute your claims of abuse or to cross-file and get a mutual order against you as well.

This information relates to Minnesota's procedures and will likely be a bit different in Florida, but the basics should be similar.
