My uncle was involved in a disupute with his neighbor where she was verbally harassing him and committing acts of vandalism against him. He got involved in verbal altercations and she called the cops. Because he has a record, and she doesn't the cops would take her side and arrest him for "disturbing the peace" or some crap. She thought this game was fun and continued it, claiming that he made threats and she was afraid for her life...etc. The police always took her side. She even filed a restraining order against him, but then would go up to his property and start harassing him again.
My parents got involved and set up video surveillience and phone taps as well as filing a counter restraining order against this broad. So the drama gets so bad that it actually goes to court and the judge throws out the character witnesses, the video surveillience (that shows this woman destroying my uncle's cactuses on his porch with a baseball bat), and the phone conversations that have her in the background screaming and yelling at him while he's in his house. She then charges my uncle with "Making a terrorist threat" and locks him up for 250 days in solitary confinement.
He's already a troubled guy, and we're afraid he might kill himself over the harassment and being sent back to jail. On top of that, my parents are maintaining his house for him and every time the go over there, that damn harpy calls the cops on them.
What can I do (legally) to make them all suffer? I want the police department, the judge and the woman involved in some sort of lawsuit where I get some satisfaction for the misery they've caused my family. My grandmother is bankrupting herself trying to pay legal fees, and it looks like my parents (who have never even gotten a ticket for gods sake!) might be arrested for "Harassment" charges. I want revenge, and I don't want to have to wait and file a wrongful death suit because my uncle killed himself.
How do I do ANYTHING about this? How can I start a protest, or get some sort of newspaper coverage? What channels do you go through to start smack with someone legally?

I want revenge because the people in charge are using their power to hurt someone I care deeply about.
I'm not a "good" person. I don't want to turn the other cheek. I also want to make sure no one else goes through what my family has gone through just because this crazy old woman likes drama.
The police are supposed to "protect and serve" and they took an oath to do so. Call me old fashioned, but I have no sympathy for people who break their word when it's convenient.
A pyschiatrist may have a field day with me, but at least I'm trying to do this the legal way instead of the postal-ammo box way.

Where is this? What is this? Go to your newspaper, get a lawyer, find someone who will work pro-bono. Advertise this on craigslist. The very first thing I would do sometime early in the morning is make an appointment with the mayor of your town, take the mayor to the chief of police, get them together and speak them concerning your perspective. If they do nothing (be sure you have at least a tape recorder on you) proceed to take this to the world. Make this big, I want to see that judges head on a pike and that womans blood spilled for smashing your uncles cactus. Ever public servant that was involved in this should at the very least get a tattoo stating their crime as well as losing their job and being forced to live a life similar to that of what they would do to a rapist. Get lawyers and guns. I am really glad your folks recorded that woman doing that, you've got a smoking gun there. Pile up the evidence, MAKE COPIES and keep it in several secure locations. Do this and do this right. |

SUE her in civil court where you will be able to show the tapes.

i like the first answer - civil court. In a criminal complaint against your uncle, the judge would have just said "the harpy is not on trial here"and dismissed evidence against her. I'd sugggest taking the angle of "we're concerned about her - she seems demented" and seek restraining orders or psych evaluation. If she's older? she might be afraid of a retirement home, enough to back off.
also: a microcassette recorder. record each conversation. The recording will help you or your uncle remember to be polite, and give immediate proof of her lying, if she calls the cops. Probably can't be used in court (unless you say "I'm recording this OK"?), but it could make a lot of difference with how the police see the situation. When she realizes she's being recorded, it'll affect her behaviour, too - it might be good to ask her leading questions, before she knows it. Like: why did you lie my uncle into jail,
another good tactic. keep a journal of her activities. It sounds a lot better if you can recite a complete list of events, with dates and what was said.
It may well be that she has influential relatives, is why the authorities are so sympathetic to her. Your uncles record doesn't help either. If you can find out her "connections", or get her on tape telling you something like "watch it, my cousins a city councilman "or such, then maybe you could get a newspaper interested in the story- or political opponenets of her connection.
Seems likely that your uncles record gives her some justification for concern. Maybe he could send her a letter, explaining that he's just trying to exist, has no intention of doing wrong again and asking for a chance. His lawyer should send it, and keep a copy - contact her only through attorney. It'll sound real good in your journal of her activities, at least.
Hoping to get revenge on the judge and cops is counterproductive, and unlikely unless you've got an unlimited legal budget. You need to persuade them. If she calls the cops, and you have a tape proving that she's lying, or starting the trouble it could make a lot of difference. Any chance your uncle could get a roommate? it'd be very handy to have a full- time witness available.
Geting your uncle out with an appeal is much more likely, if you can win a civil case against her for her demented harassment of anybody who goes over there. Good luck |

Video and phone taps are not admissible as evidence in court (except possibly civil) to the best of my knowledge.
I find it interesting that instead of getting justice, you want to make as many people as possible suffer over this. A psychiatrist would have a field day with that, which is admissible in court. |
