If someone claims they have been badly hurt in a car crash but haven't, and you have covert film to prove this, what legislation/cpr rule allows you to use it?

The camera has or should have (as most have) a date and time, that it records the event off.
This becomes evidence as to the event next you have to document the person who took the tape as the recorder to testify that this did in fact take place as it is shown.
The camera and person will have to be subpoena into evidence in the case. |

Rules of evidence generally apply unless it is a lawsuit against you.
If the case is against you,your attorney can enter it into evidence.
If you know of a scam and a video that can prove it,you can go to the court clerk and ask to appear as a friend of the court with evidence that may be case related.
The attorneys on both sides will want to see the tape for review as well as the judge to determine admittance or not. |

Its rules of evidence. If its criminal court, contact you state's attorneys office. It can be used as evidence in a criminal case because it was filmed by you and you were not acting as an 'agent' of the police or prosecutor's office.
If its civil. Check the court dockets for the case (or inquire at the court) and see who the party being sued is in the case. If its an insurance company I'm sure they'll be glad to use the video. |
