Do you have to plead not guilty? Just got my second speeding ticket within a year, and afraid of all the points and insurance increases. Do you have to say you weren't speeding? Any suggestions? Additional Details What does it mean to plead No Contest, and what is likely to happen? By the way, I HAVE BEEN driving slower, but was having a bad day.

You fight it by paying the thing, watch your insurance rates go up and QUIT DOING IT!
Pleading "No Contest" means that you agree the state has enough evidence to convict you of the crime regardless of any evidence that you have. It basically is the same as a guilty plea. It's called an "Alford Plea". You can research it. |

Plead not guilty and set a trial. Before the trial you can try to plea bargain with the prosecutor. Failing that, defend by cross-examining the cop. You will not be required to testify at the trial if you do not want to. If you choose to testify, it will be subject to penalties for perjury, just like any other witness. |

You can plead guilty and pay the fine; you can plead not guilty and put the onus on the officer in court to prove it (and you'll probably be found guilty); or you can plead no contest - which is essentially the same thing as pleading guilty.
You don't HAVE to say a thing, and you don't HAVE to plead not guilty.... it's your option.

Your best bet is to contact the courts and ask them these questions. They are the ones who will process your ticket and will know all the laws and regulation. You should also ask the courts if you are allowed to take a driving school class. This will prevent your insurance from going up and points from being placed on your license. Just make sure you get the courts permission before doing so. If you don’t the courts will reject your driving school certificate. Good luck! |

No Contest means that you aren't admitting guilt, but you are saying that you cannot offer an effective defense. The Court treats a plea of 'no contest' the same as 'guilty' for the purposes of sentencing.
If you are concerned about points, you can request traffic school. In most states you get one opportunity to attend traffic school within a certain time frame (18 months in California). Successful completion of the course will keep the points off of your record and the insurance company will not know about it unless you tell them.
If you have already attended traffic school, some states (such as California) offer a 'second offender' program that will keep the points off of your license. However, if you take advantage of that program the offense will STILL show up on your driving record (as 0 points) and your insurance will see it; furthermore it will tell them that you must have had another citation, so they can now hit you for both.
I do not recommend you try to actually fight the ticket unless you can offer strong evidence in your defense. You will lose any case where it comes down to your word versus the Officers. In some states, challenging the ticket and losing can expose you to additional court fees; the Judge may also be less likely to offer you traffic school if you make a particularly pathetic attempt to lie about the ticket. |

Hire a traffic attorney, usually they can get it tossed or reduced.
The cost of such an attorney is usually about $200, but depends on the area, and often covers any fines or fees, and saves you from having to take time off of work to attend court, and will probably pay for itself.
No contest means you say they can fine you, and find you guilty, but you do do not plead guilty. It is almost as bad as pleading guilty. |

Personally I feel you should plead guilty. You committed the crime, you should take your punishment and move on.
However, if you want to try and fight the ticket, the best way in your situation is discredit the police officers method of determining your speed. Radar gun not calibrated, officer to far away to accurately tell your speed, weather affected radar, those are a few factors that could do it. But there was a lot of info you would have needed to collect at the time of the ticket to do this properly.
Hopefully everything was kosher on the police officers end and you are found guilty. |

When you go to court you can talk to the prosecutor. They will usually drop the points for a higher fine. It's a fundraiser for the town. In NJ you can drop points tickets to unsafe operation of a motor vehicle which is no points but an expensive fine. Prosecutors will make a deal if it benefits the town.
In NJ there is ALWAYS a prosecutor at traffic court. It's the man or woman that sits a little desk near the front of the courtroom and always has a line of people crowded around him/her waiting to talk to him/her. Get you facts straight and don't call people idiots |

The idiots talking about "talk to the prosecutor" (there is no "prosecutor" in traffic court) or take it to trial (there is "trial" in traffic court) don't have any idea what they're talking about, as usual.
There is no way to fight a speeding ticket. Cops don't make up speeding tickets, you have no case. If you didn't go to traffic school for the last one you can go - OR, if you're in CA, there is a special traffic school you can go to if you have went in less than 18 months, where you have to request it from the judge - it's a 12 hour course and more expensive but it does erase the ticket from your public record. You have to go to court and ask the judge for this. |

A bad day for you resulting in speeding could easily end up being a bad day for parents who lose their child because of your recklessness.
What you SHOULD do is grow up and take responsibility for your actions like an adult.
Going to court and pleading not guilty to something you admit to doing is pathetic.

the only way would be to buy a new spedometer, have it put in and bring the reciept to court and tell them at the time your spedometer was broken and show them the reciept. but thats much more expensive than the ticket. |
