Hello Chante. Sealing a record is for minors ( committting a crime under the age of 18) and when the person reaches majority age, the record can be sealed.
Expungement is for persons over the age of 18.
Each state is completely different in their expungement rules but certain rules are standard.
Only a first time felony can be expunged. Most states demand 5 years free and clear of all legal encumbranes and some states demand 7 years. Each state has it's own rules over which crimes may or may not be allowed to be expunged.
Misdemeanors can usually be expunged after 1 year. For a misdemeanor, you can usually get a motion to expunge a misdemeanor at the Clerk of Courts in the county of arrest/conviction. Fill it out, return it with the filing fee and you will be notified by mail.
For a felony, it is more complicated. Best advice ( although NOT the cheapest) would be to have a consultation with an attorney in the jurisdiction of the arrest/convicition and see if you qualify. If so, the attorney can draw up your petition and submit it to the court in your behalf. A court appearance is not needed for this type of motion and you will be notified by mail.
Depending on how the attorney values his time and the amount of work he would need to do in your behalf, you can expect to pay between $750 and $2,000. At your initial consultation, the attorney will tell you what he will charge once he has the full details.
