My fiance physically abused me, choked me and punched me in the back of the head right in front of our babies. It's not the first time, but it's the first time I called the police. He was not arrested, I had no physical evidence, the police told me to go to magisstrate office and press charges and they would issue an warrant for his arresst. I am going to follow through. How will this affect his record? I heard that he could do counseling and have it expunged from his record, if it's the first offense (just the first offense I reported though)? I don't know how this works. But I want him to pay for what he done to me and the kids.

It depends on what state you live, but in most states it will never be off his record. He'll never be able to own a gun again (so there's one less thing you'll have to worry about!) and in most states he'll serve mandatory jail time, so dont worry about him just getting off with a fine. Dont let anybody tell you you're overreacting by pressing charges, it is never ok for a man to hit a woman and he deserves to pay for what he did to you.

Do the right thing and file the report. He will be prohibited from getting jobs for this. It can only be taken off record if the prosecutor offers it to him BEFORE the decision is made. In this case, I don't think that will happen. If he is guilty, and over the age of 18, he cannot have this offense expunged from his record. |
