i was walking across the cul de sac i live in, from my uncles house to my own, and i stopped just off the pavement to get the keys out of my sons nappy bag. i had him in front of me, and a woman reversed out of her drive into me, and i flew forward and fell holding onto my son. i went to the hospital to have xrays taken as i already have back problems. I went to report her at the police station, as 1) she doesn't have a driving license, and 2) she was drink driving at the weekend, and is a known drug user.
the police officer informed me that if i made a formal complaint, I would be cautioned, for jay walking... and the social services would investigate me!! Now i know that i shouldn't have stopped where i did, and i accept that, but i don't see how it is fair that a woman with no license gets away with all she does. what if it had have been a child she reversed into?

First he can't give you a jay walking ticket if he didn't see you do it. Second, if she hit you and you reported it the officer MUST make a report. Unfortunately she won't be charged with DUI because there was no officer there to test her or question her about the incident.
Depending on your state, and whether you continue to pursue charges, she can be charged with negligent injury, driving without a license, endangering a child, and careless driving. |

That lazy cop just want to scare you off so he wouldn't have to fill up the papers, he can't give you a jay walking caution cause he wasn't there, keep up with the formal complaint. |

jay walking in a cul de sac???? how is that justified. she knocked you down putting your son and you in danger. also the fact she had been drinking and no license surely the court would see your point. also what social service gotta do with anything but the first thing they will do will do is check your home so dont be too worried she needs to be stopped before she does it again! you have done nothing wrong i mean fair enough if you did on a through road but you didnt expect it. i would carry on with the complaint. |
