i was convicted of theft and burlary in 1995 and recieved a 12mths conditional discharge.in october 2008 i applied to be a health carer ,i recieved my discloser back in march 2009 with my conviction still on there..been as it was 14 years ago i thought it would have been spent..can you help me???,

Are you in Canada?
A 12 month conditional discharge should be done after the 12 months. I would go to the courthouse to find out how you can go about having it removed from your record. It could be a clerical error.
ETA- i don't understand the thumbs down. In Canada, a conditional discharge means that if you complete the required probation order for the specified period, and don't get in trouble again for that time period, the conviction will be discharged meaning that IT WILL NOT be on your criminal record. Maybe thats not how it is in the US but thats how it is here. |

I you are in UK it will remain on your criminal record for life and show up on all CRB checks which are required for jobs such as you mention.The Rehabilitation of Offenders Act does cause certain offences to become spent and yours would be spent which means you don't have to declare them if asked if you have previous convictions in most jobs but jobs such as carers,health,police etc are exempted from the Act. |

It's on there forever.
You people who do these stupid crimes never learn. A record is a record. Your crime doesn't go away after a certain period, it stays on there forever. So later, when you become responsible and want to get a real job, they do a background check and see you committed crimes and do not hire you.
I wish all the young criminals in here proud of their crimes could read this post. |

It will remain on your record forever, but yours was considered "rehabilitated" after 12 months.
A rehabilitation period is a set length of time from the date of conviction. After this period, with certain exceptions, an ex-offender is not normally obliged to mention their conviction when applying for a job or obtaining insurance, or when involved in criminal or civil proceedings.
It will still appear, though, on a search. |

UK it stays on forever, trivial crimes are discarded by most employers after 7 years and time spent in jail discarded after 15 year except major crimes like murder. It is hard to get a job in the care industry with a criminal record as the Care Commission are very strict - daughter is a carer with a clea record and my partner is a security guard and needed CRB check for his SIA license. |
