I recently had to go to court, and my trial date was reset for May 20th 2009. I did qualify for a Public Defender, so that takes a lot of stress off of me. The only thing is that I went to court on April 1st, and it is now the 15th, and this Public Defender has not contacted me yet to set up a date to meet, and talk about my case. The court date is not until May 20th, but I have called him 2 times and left a message, and he has not attempted to contact me. How long does it normally take for the Public Defender to call? Should I call the defender's office and tell them that he has not contacted me and that I am worried, or ask for another defender? I don't know how these things work

I am just worried it will be something like he doesn't see me until the day of the trial... He has to show up right? The case is cut and dry... My boyfriend got drunk and said I pushed him on the bed a tore his necklace. I did not do any of the sort, and he cannot remeber a thing that happened because he was too intoxicated. I am in trial for domestic violence. But I didn't push him on the bed or rip his necklace. He was so drunk when he called the cops and they took me because they I guess have to when it is a domestic dispute. They let me out without paying bond too, and the cop said he would be there for my defense. I didn't do it, honestly, and he was so drunk he has no recognition of ANYTHING that happened that night

I agree with the first two answers. If you wait until court date, you'll more than likely see him 15 minutes before . A public defender is ok, but limited in what he or she are willing to do. If you need representation on a serious matter, I would consider getting a private attorney. |

uh, they were suppose to exchange numbers- give you his/her number. Call the court and get the atty's number. They can call you whenever. When you are in jail, they dont see you at times, until the day of court. I know you obviously arent in jail, but that kind of gives you an idea. Public defenders are good (or at least in my experiences they have WELL worth it! I mean come on, their free). But he maybe busy, so you should contact him.
Oh I read the actual post, well then they can reset your date if you tell the court you're not ready, I would then say, "maybe I should be re.assigned to a different public defender" |

PDs, in general, are outstanding trial lawyers but they do not have the time or inclination to hold your hand. The PD will return your call when he/she needs more information on how to defend you, not when you feel the need to give more info. |

to my understanding a public defender is not for the people, and folks don't understand that, their not there to help you, their there to get you to plead guity or help the trial lawyer, they working for the judge and the trial lawyer comparing notes and trying to figure out what's the best way to hem you up by coming up with a plead deal. they never contact you, you can call them some wont even call back some will, some wont even return phone calls. you mite have to go to their office, if i was you i would fire that public defender and get a paid lawyer, you can never trust a public defender, a paid lawyer will help you if your retainer is good, pay half now pay the rest later, you can get a good lawyer for about 1,500 doolars it's worth it if you wanna stay outta jail. |
