How long have the magistrates court got to prosercute some one for a driving offence?

is there a time limit from being accused to the trial?

Depends what it is. If it's a minor discretion it used to be 6 months - that's going back at least 4 years though (in UK). A serious offence though would be different.

From what you say it is alleged that you contravened a red traffic light, if seen by police, punishable with an endorseable Fixed Penalty notice (3 points 60 pound fine), no doubt yours was a camera?, initially you have 14 days from the date of the offence to receive a notice of intended prosecution (NIP), unless you were not the registered owner of the vehicle, in which case you have 14 days to receive a NIP after being identified as the offender. The Police then have 6 Months to summonses you to court, once the summons is laid there are no time limits. Usually if the Offender does not reply to the summons (and Offenders are given a lot of chances, all recorded), the offence is heard at court in the absence of the Offender, and a verdict is given by the court. An Offender has the right to appeal against the finding. Occasionally things don't go to plan, so i would suggest that if you are aware that you may have an outstanding matter too which you have not received a court date, try either contacting the Police Officer or relevant Department as well as the courts, as this may rear it's ugly head when you least expect it.

What do you mean by accused? By a police at the lights? Or by letter?

If by police, depends on whether you were warned at the time. If you were not then the police have 14 days to give you a Notice of Intended Prosecution. After that it is too late for them to do so.

you can check with the court,(where you live),and see if and when will the case be going to trial. they should be able to tell you.every case is different.good luck.
