He has been sentenced previously for a similar offence. It is likely that this matter will proceed to Crown Court if this amount is deemed commercial cultivation and 7 ounces is a lot of cannabis. In addition being in possession of class A is a seriously aggravating factor if that is not charged separately. It is unlikely he will be sentenced to less than 6 months although if he is medically shown to have mental health problems allowance would be made. |

not long enough.i live in australia and our laws are crap. don't know what your are like. he's only getting help because he got busted and your parents are paying/making him do it. you'll find that he will still use, he needs to make the first step and want help, a decision he has to make entirely by himself. i hope he does straighten out, if he doesn't cut all ties with him until he does, it will only get worse. tell him to get rid of the junkie girlfriend it may help, at the very least there wont be anymore unwanted babies brought into the world. i wish you and your brother the best of luck though, you and your family are going to need it. |

If he is in the UK, you mentioned £2 so I assume that he is.
It is unlikely that he will go to prison for long (If at all) that is assuming that they don't add an intent to supply charge.
His Dr can supply the methadone on the NHS so there is no need to pay for it privately |

I know in the West Midlands the police are mostly only giving cautions for growing if there are under 20 plants. You're parents getting him private treatment will be looked on as favourable by the courts, it shows they are decent people who love their son and are doing all they can to help him before putting a strain on the public resources. 7 oz is nothing to get caught with, I expect he will get community service and drug counselling. |

The max sentence for cultivation is 14 yrs as your brother has previous he should expect a substantial prison sentence, rehab is not going to be an option in this case, even if he gave the cannabis to friends for money or not he is still guilty of intent to supply. The stupid thing is the street value of his seizure is just under 300 quid, it may serve a purpose for your bro to do a spell inside, they have drug programs and drug free wings so if he uses whilst inside it will be because he looked for it. Your parents are not really helping as the work and commitment needs to come from your bro and he has to face the consequences of his . The courts have this all the time when the person is arrested all of a sudden its lets get treatment this is now overused and there are stats to confirm that rehabs are failing because the addict fails to comply with the conditions and returns to using, the question here is not about your brothers heroin abuse but that he was caught cultivating a totally different drug. Let your brother pay the price and also the choice of HIM not committing criminal offences. Up to the point of arrest he was a criminal and he now has to suffer the outcome but also if he wants to remain doing crime. |

very unlikely to receive a jail sentence. If he has genuine mental health issues and the fact that the amount is very small he will prob get a fine and a suspended sentence of 3-6 months

In my experience it would not normally be a custodial sentence for growing 7oz quanitity unless the prosecution will be saying that he grew a lot more and sold it off. I would expect that he will be facing a suspended senetnce of 6 months and fine. I am a criminal defence solicitor |

The courts will take into account your parents willingness to try and help but the main thing is if he will agree to the help. If your brother shows a commitment to change his behaviour he may get away without a custodial sentence, it really depends on your brothers attitude!
Hope this helps! |

Well said Simple Si - you get my vote for Top Answer.
Cyrus M - with an answer like that you're obviously a poser too.
Confused Witness: sensible maybe, but that doesn't change the fact that he's an obvious poser. |

a very long time. drugs are on the rise these days, and just carrying supplies to grow/smoke/deal drugs, and not having drugs on you yourself, you can get arrested for 'conspiracy' to grow/sell/deal/take drugs
its stupid, but hopefully he will get let off with service or a fine, if not,m see him in 3-7 years |
