Husband got third dui in 10 years?

We live in Illinois, I don't think our marriage is going to make it through this. I am wondering what his is going to happen? Does anyone know what his punishment is going to be? I went on the Illinois DMV website and it said he might possibly get 3-7 years ( which, by the way, I think he deserves). Does anyone know what the probable punishment will be? I am just trying to figure out what I need to do!? Other than dump his drunk *ss that is.

To badbob, the legal limit in Illinois has been .08 for years now. My husband's daily drinking has been an issue with us for years too. But, in an attempt to prevent this or worse from happening, I have always told him that if he was going to be out drinking, he should stay with freinds, I don't know about anyone else, but I personally don't know of anyone who would be okay with their husbands staying overnight, other than myself that is. He knew better, and he will more than likely get what he deserves. He has single handedly ruined his life and ours too if I stay with him. My question is not whether I should stay with him, or IF he should be punished, because I know that I should (and probably will) leave, and I know that he deserves to get his *ss kicked in court, I want to know what I need to do to protect myself, and our son from the problems that his irresponsibilty, and inconsideration have brought into our lives! Thankyou though to all that are answering!

If the DMV sentence says 3-7 years he will most likely get 3 years and let out in less than one. A friend of mine on a 3rd time was sentenced to 3-5 and got out in 10 months. It varies on the judge his past history. His lifestyle. The judge/jury will take this all in and see what he deserves.

In my opinion anyone that gets their second DUI should be locked up for a minimum of 10 years

Well, I think you need to start with your suggestion and that pretty much covers everything else.

I'm sorry for what you're going through. Unfortunately, I know all about it. Sad fact is, I've seen too many multiple DUIers get wrist slapped until they kill somebody.

Here's what it boils down to. You can't help someone who doesn't want it. If you want to save your marriage, you'll have to convince him to get Professional help. And that is one of the most difficult things to do.

It would be wise to separate your legal obligations from hia as soon as possible.

In Alaska, it is a mandatory year in jail. In most states, the third DUI in 10 years is a felony, punishable by a year and a day or more incarceration.

It should be relatively simple to obtain a divorce if he is convicted. Then, sory to say, it will be time for you to take a good long look at yourself. Alcoholism is a disease, and a rather curious one. It affects anyone who lives with or loves an alcoholic, and the same sort of symptoms (often without the drinking) occur with the co-dependent.

You can choose to look for and fix that problem or to live your life as a victim. Your call.

Anyway, I would advise against marrying any more alcoholics or heavy drinkers or maybe any drinkers at all. You do not need any more abuse, whether it was mental emotional physical or a combination of more than one.

Hello, My brother got 3 and did 18 months in jail. ( Prison) He got out early for being polite and following rules. It cost him 3,000 dollars too.

A friend of mine on his second DWI had MADD setting in the court room. The judge trying to appease MADD gave him 8 years. The founder of MADD had her daughter killed by a drunk driver. She now is a lobbyist for the liquor industry. So much for her daughter's memory.

They say not knowing the law is no excuse for breaking it yet with as fast as these useless, oppressive laws are written no man could keep informed. These laws allow the government to now take everything a man has worked for his whole life with total disregard of the Constitution.

Your husband is in a bad spot and is going to need all the luck in the world to avoid a few years in prison. He would have been better off facing a charge of armed robbery, rape or 2nd degree murder as the punishment no longer fit the crimes in this crazy country. For this country being so damn free why do we have more people in prison than any country on Earth?
