My dad wants me to go to court to fight it but I'm not sure it's worth it. I was going 93 miles an hour and im 18. The cop only wrote me up for 15 over but i think that's four points on my license and my dad wants me to try to get it removed because the insurance will be super expensive now. Anyway does anyone have any knowledge on the subject??

here is what you do for it to not appear to your insurance
pay the fine.. go to drivers school for about 8 hours and if you don't get another ticket for a year it won't show up!!

You WERE speeding. Your insurance HAS ALREADY gone up. Fighting the ticket won't change that. Give your father a break and get your own insurance. At 18, you shouldn't be on his anyway. |

Ha. The officer did you a huge favor by writing you for less. The penalty for speeding usually goes in increments of 1-15, 16-25, etc. Plus it depends what the speed limit was where you were speeding.
I'm not sure where you live, but where I do, there aren't any speeding tickets that are four points--unless you were cited for multiple infractions.
In order to avoid the ticket, you would have to prove that you were not even going ONE mph over the speed limit. The rest would just be the amount of the fine. An attorney might be able to help you with that reduction. |

I can understand your dad's concern about insurance rates going up. I received a couple of speeding tickets after I started driving and the tickets caused my rates to go up dramatically.
It sounds like the police officer took sympathy on you when he only wrote you for 15 over. In some states, 20 over the speed limit would be cause for arrest and impounding your car.
I would not recommend fighting the ticket, but depending on your state, there may be other alternatives: 1) Deferred Adjudication (Probation) or 2) Defensive Driving.
With Probation, you are given a certain period of time to prove to the court that you will not commit another moving violation. Generally, the Probation is limited to the city or county from which you received the original ticket. So, for example, if you received the ticket in Jackson, MS from a Jackson Police Officer, Probation would mean that for the given period of time (generally 90 days), you would not receive another moving violation from a Jackson Police Officer. If you meet the conditions of Probation, the ticket does not go on your record (or the points are not applied).
Defensive Driving allows you to take a state approved class and upon successful completion will allow the ticket to be kept off of your record. In some states, an additional certificate can be received from the traffic school which can be applied as a discount to your insurance (generally applies for 3 years).
In both of these cases, arrangements are made with the Clerk of Court's office prior to your court date (i.e., you speak to the court, not the District Attorney or Judge). Call the number listed on the back of your ticket and ask them your options. Let them know that you do not want to contest the ticket but want to know if there is a way to keep the ticket off of your record. They will let you know whether anything can be done. This is another advantage to you afforded by the police officer only writing the ticket for 15 mph over the speed limit. Generally over this amount and you are not eligible for Probation or Defensive Driving. Don't be afraid to speak to the Clerk over the phone. This does not commit you to anything. Once they provide you the information, and you decide what to do, you can then go to the Clerk's office and make the arrangements. With either option, you should still expect to pay some sort of fine and court costs, but the ticket would stay off your record.
By the way, this is all something that you can take care of yourself and without the need for an attorney. Be wary of an attorney says that they can help you keep the ticket off of your record. They may simply file all the paperwork for you to have one of the options and charge you additional unnecessary fees in the process.

Your best bet is to contact the courts and ask them these questions They are the ones who will process your ticket and will know all the laws and regulation. You should also ask the courts if you are allowed to take a driving school class. This will prevent your insurance from going up and points from being placed on your license. Just make sure you get the courts permission before doing so. If you don’t the courts will reject your driving school certificate. Good luck! |

Your insurance will not go up, unless you've had a ticket before, because you can attend Traffic Violator's school. Pay the fine, and the issuing county courthouse will mail you a packet with a list of Traffic Violator's schools, and you pick one, and attend.
Once you graduate the 8 hours course, or however long it is now, the points will not get reported to the DMV.
Ticket points do not go against you until the ticket has been sent to the Department of Motor Vehicles. |

You can go to court, but you know you were guilty. I would just pay it. He was nice enough not to take your license away.
You can take the courses that will help you get your points removed. You can either take the traffic course when they schedule it, or you can order the video and watch it. You cannot fake it because it will give you answers to questions and if you are not watching it, you will miss them. Ask the license branch about them. |

You were going 93 mph? city streets or highway? that's way over the speed limit, what are you planing to say at court?, kid you have no chances to make it disappear, going to court would be a waste of time, just give thanks to God that you didn't run over a person or had an accident. |

you really should just pay it.....unless your rich and can afford the court fees, you could take a chance and have the ticket reduced if your lucky and have a valid explanation, which is in truth unlikely. |

The cop did you a huge favor for not writing up Violation of Basic Law, with notation of true speed details. If you go to court, this whole matter will risk becoming license suspension outright, in view of that car full of kids you nearly murdered. Your Dad wants to minimize things, of course, and they already are that way right now. Take your lumps, and stop being a dangerous criminal. Save it for a trophy run at the dragstrip next sunday. |

Its not you who committed the offence, its your legal person. Your person is a fictitious company created when your birth was registered, thats why the court summons will have your name in capital letters denoting a company not an individual. The court is a place of business which tricks you into contracting. All law is commercial and all commerce requires a contract.
In my opinion its too late to fight this as you have already signed and therefore have associated yourself with your person and you have unknowingly agreed to contract with the court. The court operates in a state of mercantile equity which is heavily biased against you so at the very least you would need to change the court from equity to common law as you actually have rights under English common law.
Give it up and chalk it to experience as its a waste of your time fighting in an equity court. |
