lose job and arrested. u work at a store in ames iowa and think u are a 9/11 threat enough to mace someone. i would expect him to sue you personally and whoever u work for. seriously lottering??? you are probably 2 dumb to become a real cop so u think u have power as a rental cop. u cant arrest someone u are a security guard. i hope the only person gettign arrested here is you. |

If you maced anyone, Down's Syndrome or not, that person had better have been physically attacking you or giving a serious threat to, and I were a cop taking the call afterward, I might arrest him for loitering, but I'd jail your butt for assault faster than your boss could say "you're fired."
9/11? Are you serious? The guys who did that were doing things a little stronger than loitering, and they were a little higher-functioning people than Downies.
I'm frankly more frightened of security guards with your mentality than I am of any terrorist. |

If he used no force, then you had no right to mace him, and you should be sued.
You can only match force, if he had no weapon, and passively resisted, you have no right or authority to use force.
If you maced me, I would have shot you. See use of force continum.

to respond to some of the responders. I as a citizen of this country can arrest people, you do not have to be a law enforcement official. It is called a citizens arrest and the requirements for it are located in state law and differ by area. Personally, this guy is going to get sued. that is my opinion.

I just realized loitering is at worse a misdemeanor and in most states you as a citizen (which is where a security guard derives their powers to arrest from) cannot arrest for a misdemeanor. Dude, you are probably going to jail for assault, and false arrest/imprisonment.

When I was a Security Officer, I carried an H&K .40 version 3 with tritium backlighting and a Bushmaster AR-15.
Security Officers can arrest in ALL states. But they need to know what they are doing. |

My God !what goes around comes around i knew someone that made fun of down syndrome people and she ended up with a down syndrome sister. You are only a security guard --not God your job has gone to your head. That down syndrome person could have been lost and in need of being found. You should be seriously ashamed of your self take that seriously and check yourself before you wreck yourself |

did he understand that he was doing something wrong? i think maybe you were a little overzealous. most people with Down's Syndrome are honest, kind, loving, innocent and hopefully, for your sake, forgiving. you lack common sense and compassion. another vote for "drop the soap" |

A security guard? Loitering? Taking your job too seriously has definitely caused you problems this time. Please don't pretend you did not know he had Downs Syndrome. In the end I think you will be the one standing in front of a judge in a civil law suit. By the by, a security guard cannot arrest anyone. You have to call a cop and I am quite sure they would not approve of you macing a person with Downs Syndrome for loitering. If you really want to be a cop, go to school to become one. I hope they take your "watch" away. You are the reason they do not give most security guards guns. Get a life and a real job!!!

Very funny.
C'mon people, can't you see this guy's just talking out his @ss for kicks? No security guard in the country can legally perform a citizen's arrest just for loitering. Even in cases of trespassing, the most a private guard (just like the property owner) can do is either escort the person out or call the police on him. And chances are, if you assault a guy with down's syndrome, he might break you in half just by accident - those people are friggin' STRONG. |

what did he do to make you mace him> you can not arrest him cause a security guard has no powers of arrest. you can only detain them.to mace someone you have to feel threatened or in fear of the guy. you never mentioned a single thing the guy did but loiter.he did nothing to get maced. in fact you could have been charged with assault for spraying the guy |
