A little over a year ago i shoplifted about $100 worth of clothes from macy's, and got caught.
I am in no way saying that what i did was right or justified, and i have certainly learned my lesson, but now i am sixteen years old and am applying for jobs.
I was not "convicted" and plead guilty, paying my fines and completing my community service withing the time allowed. I havent been in trouble with the law since when and i wouldn't dream of trying to steal from any stores again; it simply isn't worth it.
I understand that what i did was very wrong and of course if i could go back and change it, i would. So please, don't lecture me about learning my lesson or realizing the consequences, because I think about it and lecture myself on a daily basis.
Sooo...long story short, my question is:
being that i wasn't actually convicted of the crime and it was only a misdemeanor offense, and the probation officer said something about the files being "burned, shredded, buried, whatever..." (yes, she did actually say that,) does that actually mean that it wont show up in a background check?
(i believe they did say it was off my record but now im just freaking myself out, could this charge still come up on my background check, especially since it was so recent?)
(and i want to do something in retail...) Additional Details yess...but you see, i pleaded guilty to having shoplifting so that it wouldn't be taken to court. and supposedly i therefore wasn't actually convicted.
this is why it's confusing to me.

Heres how it works, pleaing guilty is accepting responsibility for a crime you have committed, you are stating that you are responsible for the committed crime, when you are convicted of a crime you have been deamed responsible for a crime by other means, in a sense pleaing guilty and being convicted yield the same results (for misdemeanors anyway). Your probation officer must be mistaken because all criminal activity is permanently recorded, in case it is needed for future refrence. I have personal access to criminal databases with my job and sometimes violations come up from as far as fifteen years ago. However crimes can be "removed" from your record in a sense that a limited amount of authorities will have acess to the information. They do this so civilians cant just look up someones background and know everything about their past by request, but employers often will gain acess to these reports via various agencies with acess to criminal databases.
That being said and to answer your question, it is possible for them to see your criminal record with your shoplifting charge, however most non-professional jobs (like fast food, retail, resturaunts, etc...) just expect honesty in their application process and do not conduct such in-depth background checks. But if this store is serious enough, they most certainly CAN see that violation. |

Yes. A thorough background check like those done by law enforcement agencies and the federal government for security clearances will find it. Whatever you do, don't ever lie about it or your chances of being cleared for sensitive jobs are gone. All you can do is keep your record clean and be prepared to demonstrate in a few years what steps you have taken in your life to not have another infraction. Nobody is perfect and what you do from here on out is what will count in the long run. Be honest. |

When you plead guilty and then have to see a probation officer and do community service, that mean you have been convicted. The PO only said that to you cause your parents were probably up his ***. Now since you are a juvi your records will be sealed when you become an adult. Also on most job apps it states have you ever been convicted of a crime. You can not say no. Good luck if your parents got dough ask to get a lawyer and have it expunged(SP?) from your record or removed. |

The first problem is that when you plead "guilty", you admitted to the facts, and were fined and given probation, You were convicted. Since you were a juvenile, it should not appear on your record. Most states keep their juvenile records sealed, so you should be alright. |

It depends on how in depth the background check is. For most background checks it will not show up as juvenile arrests are not public record. However,it may show up as an arrest but no conviction on a comprehensive law enforcement background check. These are ussually done on people wanting to be a police officer or law enployee. My dad is a cop so that's where i got the info. hope it helps! |
