I got a ticket for going 59 mph in a 40 mph zone, do you think i can win the court trial?
Find answers to your legal question.

I got a ticket for going 59 mph in a 40 mph zone, do you think i can win the court trial?

i got a ticket for going 59 mpf in a 40 mph zone. My actual speed according to the officer was really 69, but he told me that he was going to write 59 on the ticket, and that if i chose to go to court, he would tell the judge my real speed. ( 69). he did also write 69 mph on the ticket too, on the side i dont know what that was about tho.

Anyways, what I am going to say in court is that ther is no way that that speed is the speed of my vehicle because there was another vehicle that was between my vehicle and the police officer's the whole time that he couldve gotten my speed. And im going to bring my friend to court with me, and im going to point at him when i say this to the jusdge to say that He was the driver that was between me and the officer. and that the speed shown on the ticket was not my speed but the other driver's. What do you think, you think this is a good case and I will win or what? good idea right?

most police officers dont show up for traffic tickets..go to court and if you see the officer there (which is unlikely) then just go.if hes not there then you win

There is no way you will win. Also, your friend will be in very serious trouble for lying to a judge under oath. (This is a felony in most states, and unlike a speeding ticket, can actually land you in jail). Judges aren't stupid, they have seen it all, and they can tell in two minutes when someone is lying. And besides, even if the judge somehow believes your story, then your friend would be guilty of speeding and he would have to take the same penalty that you would have.

Bad idea! I'm sure the Judge has heard every excuse by now. Just be glad that the police officer cut you a break and take this as a warning to slow down. Plead guilty to the 59 and take responsibility for your actions

The officer wrote 59 so you would still be able to go to traffic school, because you were within the 20 mile per hour limit. Outside of 20 miles per hour and you would not be offered traffic school by the court. He wrote 69 on the actual citation, off to the side, so that in court he can later testify to what you just said...that you were actually going 69 and he documented it on the citation at that time. He'll also tell the judge why he wrote 59 (which is the traffic school thing I mentioned above).

I hate to tell you that your theory on the vehicle in front of you won't fly...but it won't. Unless the officer was standing in the lane in front of you, that's the only way the other car would have totally impeded the Lidar (laser used for speed enforcement). At several hundred feet, the beam of the Lidar is only about 4 feet across. It's not like the old radars that covered the whole road. The Lidar is vehicle specific. As to the early talk about your friend's vehicle being between you and the officer, guaranteed the officer was off to the side of the road, at an angle. That said, if your friend was in front of you in the lane, the officer could have measured both of your speeds before you even saw him. That's the beauty of Lidar. Trust me, I know because I use it daily.

I don't really like your odds.
At the time you got the citation if you didn't
rant and rave and give the cop a really bad time
it's true that he might not appear in court. But, if
you were hostile with him then you can bet that he
will be there.
I suspect that your speed was probably just like the
cop wrote it. If so, take your medicine.
If you don't want to pay the fines and/or lose your
driving privilege someday then you might try driving
a little more sensibly.

sorry to rain on your parade but the court in most cases will side with the officer and the officer was also willing to save you money

i think you are hurting yourself by pushing your luck

and be honest with yourself
were you speeding?

and is there any evidence that you werent?

sorry...

It is not true that most officer do not show up. It is part of their job and they are paid and required to be there. That is criminal speed pal and he will show up. Plus your story is not plausible.

Three more words....

Slow down, loser!!

Why would your friend, who is "the stranger" go to court and "admit" that he was going at a fast speed?
How did you find "the stranger" and how do you know that it was him?
You know what forget it. Go and see what happens.

don't even try. nowadays if a cop doesn't show up to court they just reschedule you to come back. that is definitely not a good argument you have there. i am all for someone standing up for themselves but you are clearly in the wrong. also, the judge is on the cops side really. i had a cop write me up for avoiding an accident and i still couldn't argue it! i suggest that you request traffic school. sometimes, even if you aren't eligible for it the judge will still let you take it. but you will still have to pay. basically, don't piss off the judge... they don't want to be there listening to your crap.

#2 is right--the judge is going to love you. you're going to lose if you take this to court. the offier is doing you a favor by writing the ticket for 59 instead of 69. they can get you for reckless driving if it's a certain speed and that raises your fines and the points on your license. it's a really bad idea. just pay the ticket. if your going to drive that fast, you have to be willing to pay the tickets.

two words............

NO SHOT

No where in there did you say you weren't speeding. Just take your medicine, get it over-with, and don't speed anymore.

tell the judge, that in fact, you were going 69 and therefore the ticket is incorrect! if the cop wrote 59 then he is lying! in this case, driving faster is in your favor! it will work im telling you! think about it!
