I was walking, and the policeman pulls up and asks if I was driving the car (as he describes) and I said yes. He asked if I had my idea, to which I responded I didnt and must've left it in my car. He orders me to meet him at my vehicle. I didnt have my DL there either, but I knew the number and its valid. The insurance card I have was expired, though I have valid insurance. I also didn't have my front plate on the car. He gave me a citation for all 3 items.. and my car was parked on a private parking lot belonging to my company, AND I wasn't even driving when he initiated the whole thing. CAN HE DO THIS?? Or can I get out of it in court? HELP!?

Yes, he can. If he can identify you as the driver (which you ended up doing for him), and he witnesses you commit a violation (I'm assuming the plate missing was the original), he can write you a ticket on or off duty. You are responsible for any car you are in possession of, it doesn' t matter that it belongs to someone else. Make sure you take in the current insurance card to court. They usually dismiss them if you can prove you had valid insurance at the time of the stop. |

when u go to court show proof of insurance and your drivers lic and u should be OK, you may get ticketed for no front plate...wouldnt it just be easier to obey the law? like having your dr lic available, new ins card in vehicle and the plate on the front ..then u wouldnt be here asking questions.

The cop is wrong. You need a lawyer however.
If the cop didn;t see you driving the car he cannot legally testify that you were unless you admit it in court. |

YES, he can do that, a cop is a cop 24 hours a day.
