and he has a second dui with a .08...well the dmv lady says that with a alcohol level of 0.0 they can't count that as a dui first offense....is that true? i've been trying to get a hold of the lady taht handles the dui cases but i can't....please someone help...

ok....well they reduced it to a wet reckless....i looked up wet reckless which means he's driving while under the influence of alcohol...no he was not convincted of any other drug usage....but i mean it says 0.0 blood alcohol....does that mean they ahve to dismiss it? even if he was convincted....theres no evidence now that it was anything higher than a 0.0 right??

A prior offense means a conviction in court. Was he convicted? If they did a drug panel, and illegal drugs were found, it could still be considered a prior offense.
Driving Under the Influence (DUI) can be alcohol and/or drugs. |

0.0 means there was no alcohol detected in his system so it shouldn't count as a dui. |

DUI is Driving Under the Influence, of Intoxicants and / or Drugs.
A reading of 0.0 could be possible but yet under the influence of something else.
Would have to see arrest for actual charge.
If not DUI, no drugs or others noted, then yes illegal charge. |
