Yes it is legal. You were speeding so they can give you a ticket for even 1 MPH over. Some cops do give you some leway but I guess it wasn't your day today. |

Yes it is legal, but read the following just in case you get a fine again, for speeding or anything else while driving. .
Many times when you get a ticket and you use your rights to ask for a hearing in court there are several things that can happen.
1. If the policeman that gave you the ticket does not show up in court then it is automatically thrown out and you do not have to pay.
2. If he does show up and you present your case their is a good chance that you will still have to pay but the judge will sometimes reduce the fine.
3. If the policeman does show up but lost his notes on your case as to what happened then you it will also be dismissed and you will not have to pay.
From personal experience it is always best to ask for a hearing in court. You have a better chance of it the fine being reduced, or dismissed. You also have to take into consideration how many points are added on to your license depending on the infraction.
However, it does depend on your schedule. You might be losing more money by taking off from work. I just gave you some suggestions if it ever happens again. |

Yes, it's legal. Cops can give you a speeding ticket for even 1 mph over the speed limit, just most of them (that I know anyway) choose not to. |

Of course it's legal. But I am highly doubting your story. A Lamborgini doing 2MPH over the limit is like an F16 taxi-ing on the runway, It really looks stupid and no one cares. If the Officer noticed you, it was because you were doing more than 2MPH over the limit. I do believe he cut you a break and only WROTE you for 2 MPH over the limit though, and here you are slamming on the Police? For shame Speedo!!! |

Speed limits are absolute, but normally you're given somewhat of a grace. |

If you're asking if your ticket is justified, the answer it yes. In a 70 MPH zone, it is illegal to go faster than 70 MPH. You must have caught the cop on a bad day, but the ticket will hold up in court, unless you can prove that he had no way of knowing you were speeding.
Police officers have to prove that they're doing their job, just like anyone else. They do this with a paper trail. A lot of the time, your demeanor will determine whether you get a warning or a ticket. |

YES! This is perfectly legal, Im not sure why you would ask this...if it says 70, then anything 71 or over, you can get a ticket for.
Most likely, as you pointed out, the officer wanted to check out your car though. |

Good question I have wondered that myself. I have a friend who got booked like you did not much after the speed limit, so i guess it is.
It would be nice for a police officer to answer this question.

Even though according to the theory you have exceeded the speed limit, you are not prone to get a ticket. You should not get a ticket for exceeding just 2mph.
You will get a ticket (and a cop can issue a ticket) only if you exceed + or - 5mph of the designated speed limit. If it is just 2mph, please go to the nearby court and fight for it, i am damn sure that you will win it. |

Most give you a 5 mile buffer, however, if you are driving through an outskirt town, cops will do that. It's a good source of municipal income for them. So, rule of thumb, anytime you pass through a small town...go the speed limit, even if it kills ya. |

Well, I would think it is since you WERE over, but in my experiences cops don't give out tickets for anything less than 6 or 7 over the limit. But that's just how it is here. And they even let that slide sometimes unless you're 10 or 15 over depending on what area it is. But on rainy days or other adverse weather conditions, they're alot stricter. Also, I've found State Troopers to be alot stricter then the locals. |

Did you admit to it? Cops ask you questions for you to admit to something... For example, they'll say "Did you know you were speeding back there?" If you say yes. BAM thank you very much ticket! Or something like "Do you know what speed you were doing back there?" Nope!? BAM I can make up whatever speed you were doing and you cant say anything cause you admitted that you didnt know! so BAM another ticket written out.
Not sure about your laws, but Im sure you could take it back to court to fight it...if you want to run the risk that is... |

You couldn't have been very near to Houston, there are no roads with a speed limit of 70 until you get at least 2 counties away from Harris county. Anyway, if you were going 72 in a 70 you were exceeding the speed limit. |
