Please help, i stayed in a holiday home last year and took 2 inexpensive pictures and an item of crockery (really!!!!) and now i am up for theft. It is my first time involved with the police i am terrified. Please help.

What exactly is your question?
At the end of the day, what you stole is irrelevant, the fact remains that you did steal and you're admitting it to thousands of people right here.
A person commits theft if he/she dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it
Section 1, Theft Act 1968 (UK)
If you admitted it during your interview then you're probably up for a caution at the least. Maybe you'll think next time before being so dishonest and taking something that doesn't belong to you.

you will be entitled to a police caution (in the uk) if its your first offence, this is just a telling off by a police inspector and it stays on your record for 5 years and as long as you commit no further offences then its expunged.
this is highly dependant on you admitting it, and as you are on bail i find it unlikely that you have admitted it and the officer is seeking cps advice.
if you admit it then you may still get the caution. if you have already denied it, when you return on bail ask to be re interviewed. they don't have to, but tell them you will admit it on the basis of getting a caution.
if you are charged with it then convicted of it and CRB checks made of you in the future will show a conviction, so better to get a caution if you ask me.
there is always the chance that it will be "no further actioned" in which case you walk away with nothing but a local polce record, but if there is any evidence against you then thats unlikely in my opinion.

i know these are only minor things things, but they still class this as theft, if it is your first offence I'm sure you will just have to pay back the cost of the things you stole,and a tap on the hand, if you are really worried go and see a lawyer, all the best |

If you are in the UK,
It depends on the nature of the bail, if you have been bailed to return to the police station on Friday, you must do so at the time and place specified by the police, if this is the case and the owners' property has been returned to them undamaged, they might just give you a caution and let you go. If you fail to turn up a warrant for your arrest will be issued.
If you have been bailed to appear before the magistrates court.
There is nothing to fear, you will have been told a time to surrender to custody at the magistrates court. Your solicitor, if you have one, will be at the court waiting for you.
You will need to see the clerk to the court when you arrive and let him/her know you are there. If you don't then a warrant will be issued for your arrest even if you have turned up at court because they will not know you are there.
If you do not have a solicitor there will usually be a duty solicitor on hand to advise you.
You will have been given a time to turn up (usually 10.am) but you may be kept waiting, it depends on when your name comes up on the list, but you will be told which court you are in. (E.g court number 2)
The magistrates will take into consideration the value of the items, if you plead guilty or not guilty and your previous good character.
You will probably get off with a conditional discharge and court costs as this is a first offence.
It still means you will have a criminal record.

Don't worry, you won't go to prison for a first offence of this nature.

It sounds like you will just get a caution as long as you admit it.
It doesn't really matter if it was "2 inexpensive pictures and an item of crockery" - theft is theft - how would you like it if someone came into your house and stole your stuff? I'm glad you are terrified - maybe you will think twice before stealing in future. |

Well, you've just admitted a theft on here, so you might as well admit it in interview, if you haven't already, and offer to return the stolen items.
Once enquiries have been completed a decision will be made whether to charge you or not - you may just receive a formal caution.
If you're charged, in due course the CPS will decide whether or not to proceed. If they do go ahead, in due course you'll receive a summons to court. It'll be the magistrates court.
When you go to court it sounds like you'll be pleading guilty. Be very polite, contrite, and when the court asks if there's anything you want to say apologise for your stupidity and for taking up the court's time. They will listen. Magistrates are normal people like you and I.
Depending on the value of the stolen items and whether they've been recovered, as well as your spotless record it may well be just a fine.
You're entitled to a solicitor being present in your interview if you wish, the police will provide the duty solicitor if you don't have your own.

We were invited to dinner the other day by people whose home had been plundered of its cutlery and glasses and various other things by the (wealthy) people who had rented it from them as a holiday home. Not only is this theft of a despicable kind, but perhaps it hasn't struck you that it is very difficult in some places which are far from reach of any shops to replace these items. By stealing from this holiday home, you were disadvantaging not only the owner, but also the guests who arrived after you and who perhaps had to do without.
Having had my say on the subject, I would advise you when appearing in court to express remorse. At the moment you don't seem to feel badly about what you have done, but just think about the effect it may have had on the owner and subsequent guests. Don't attempt to play down the seriousness of what you did, as you have done here. Theft is serious and you will now have a criminal record. The duty solicitor will probably be able to help you. Plead guilty and tell the court that you are sorry for what you have done. Apologise for putting other people to so much trouble by your action and for taking up the court's time. Even if you have returned the objects, you may have to pay compensation for the extra expense to which you put the landlord. If you are fined, think in advance of how you may be able to pay a fine and come up with an offer if the court is prepared to allow you time to pay. If you look terrified, it will probably help, so I am not going to discourage it. |

Well taking something that doesn't belong to you is still theft no matter how small.
The only thing that may be on your side is that it is a first offence, which you may only get a slapped wrist for.

I just cant get my head around thieves.You have to try and put yourself in the position of the victim at the moment youre taking his hard earned assets.
If you really wanted the items and couldnt afford them,then you should consider awarding yourself a tax rebate for what gordon brown has stolen from you in stealth taxes.You could fiddle your tax returns,sell contraband and run on red diesel until the correct balance is restored.Then you could deny you have a TV to the unfair ,outdated,uneccessary bully,the BBC TV licensing.The money you save can then be used to buy the items fairly ,your conscience is clear and there is no victim. |

I've been a police officer for a few years now and can answerpretty much most questions you can ask about it, so mail me if im not helpful here.
You havent mentions at what stage the investigation is at, what you've been bailed for. is it for court, or back to the police station.?
How long is the bail for... this is important.?

is the definition of theft under the theft act section1 (1)
so did you take property belonging to another (whether you know that other or not), knowing that you shouldn't, and not intend to return it to them.
what you've told me is that you have.
the proceedure is the polic investigate all cirmes (they have to under law, whether people think its worth it or not) that are reported to them.
Some line of enquiry led them to you. im guessing its the fact you were the last person to stay there before the pics wen t missing. (it's hardly rocket science)
you are arrested and brought to custody, where your fingerprints photographs and DNA are taken (whether your guilty or not)
then you are interviewed to give your version of events. the nterview is on tape, under caution.
Heres where things differ...
If you admit it, they will either give you a police caution (as an adult) or a reprimand (as a youth) at the station.
which is a criminal record but essentially a slap on the wrist.
you dont get fined, you dont get prison.
it is a telling off and a second chance.
If you denied it, or made a no comment interview
wel firstly thats a stupid thing to do in any case.
but they will normlly investigate your account given in interview then take the available evidence to CPS
who will make a decision whetyher to charge or not.
(you arent given the option of a caution now, as you only get that if you admit it straight away and it's your first time in trouble)
If you are charged, you are bailed to court, where on your first appearence you make your plea.
if you go guilty you are given a fine normally, about £200 to cover court costs andthen compenstion to the victim.
if you go not guilty, you are bailed again until a full trial 6 months later, where all the evidence is heard by a magistrate and they tell you their finding.
The fine is more as court has cost more by that time and the victim has waited longer. |

when you go to court, get a duty solicitor(they are free), and plead guilty, but tell them it was peer pressure, because you mates egged you on to do it.
but most of all just be yourself, it sounds like your a good person, and they will see that.
