Since you're of age, and you did not register as intoxicated, they let you go. it really depends on the cop because you shouldn't be driving with ANY alchohol consumption. It's easy to get a DUI because drinking is such a natural way of life and people don't think much of it when they drive.

Don't do it again because you WILL get caught: Your warning is cited on your permanent record and will come up if you are suspected again and then you will be charged.

Oh yeah, that happens quite a bit. A sleepy driver is every bit as dangerous as a drunk. So pulling you over, putting you through the test, and pumping some Adrenalin in you probably kept you alert enough to get home.

There are times when somebody's inattentive driving (i.e., missing a light while going thru a purse) will get an officer's attention. A few drunks can actually pass the physical tests but can't get by the breath test. You did, so you got let go. I suppose the officer could have written you up for careless driving but that would be pushing it.

Some years ago, I stopped a guy driving all over the road. I just knew he was drunk. He could not pass a single test. But the breath test was zero. I started checking his wrists and sure enough, he was a diabetic and going into shock. So, no ticket, but a nice ride in the ambulance. . .

As a career LE officer, if that officer worked for me, he would be fired for deriliction of duty.

Had you driven a block away and had killed someone, the officer could have been found responsible in a civil court.

At the very least, you should have been arrested for Public Intoxication.

ummm, lets just say i wouldn't bet on another break like that...if you are going to drink you need to make sure you won't be driving....next time could be a complete different ending....be safe!

OK is wrong. you can be charged with DUI if you are under the legal limit. it is called "driving while impaired". it says the same thing as the .08 dui but just says that even though you were not .08 you still were intoxicated. think about the first time you drank. you had a couple beers and were falling all over. definately not over a .08, but impaired. it also covers combined influence arrests (medicine, alcohol, drugs combo) or just straight drug driving arrest.

How often? as often as they just plain know they haven't enough probable cause for the arrest or the ticket.

You probably measured .01 or .02 on the breathalyzer, enough for you to recognize the difference but not enough for any jury in the world to convict you, and therefore nothing more than a total waste of taxpayer money to proceed in that direction, money that he would rather be still in the bank for his upcoming paychecks.

Like previous contributors have said: sleepy driving can kill yourself just as dead as drunk driving. Never drive sleepy any more than you would drive drunk. Stay the night where you are, or somewhere nearby.

It's hard to give an accurate answer without knowing the BAC level. Just for future reference, keep this in mind. You do not have to register.08 or above to receive a DUI. Some people show impairment long before reaching that level, and can be charged accordingly.

There is a legal limit. You blew below it, therefore you where not breaking the law and where not arrested.
That doesn't mean you where OK to drive or that you should have been driving, it just means that legally you where under the limit.
I have seen people blow 2 times the legal limit who could walk a tightrope and do handstands, yet I have also seen people who can't walk straight, slurring who blow under the limit.

You passed the breath test or you would have been booked.

They can't charge you with DUI if your blood alcohol level is within the legal limits.
Let this be a lesson and don't do it again. Your inattention at the green light was most likely due to your alcohol consumption and could just as easily have caused you to lose control of your car as you were moving.
