Find answers to your legal question.

I ran over a police dog about a month ago, murder?

About a month ago i accidentaly ran over a police K-9, and it died. And now my court date has been set, but im woundring if i will be charge with murder of a police officer? But the thing is that the dog was on the ledge of the street and i happen to not see it; due to the sharp right turn i made. And then bam i feel something and the cops all swarmed the dog and forced me out of the car. And they know its not my fault so thats why they did not arrest me on the spot, but set a court date. What will i be charged off? Hopefully its not muder of a police officer.

In my state it would not be murder. I would imagine it would be the same all over the U.S.

We have two laws here to protect police animals, they are interfering with and assaulting a law enforcement animal.

It sounds to me like you were probably cited for a traffic violation that led to the crash (crashes aren't accidents). Maybe you were cited for an illegal turn, careless driving, failure to drive within lane, or something along those lines. If you did not receive a citation on scene, they will explain the charge when you get to court.

I would be curious to know where the dog was standing when you ran it over? Was it in the street or on the curb? If the dog ran out in front of you and you were not doing anything illegal and did not have time to stop, it don't see how you would be at fault. That would make a big difference in court.

Be glad you didn't run over a child. As a parent and police dog handler, I hope you will pay more attention when you drive.

If you drive like you spell and murder the English language, it will be Capitol Murder!!!
Secondly, a sharp right turn? Didn't see it? It was on the edge? Guess who will be going down??
What if it was a person? On the edge of the street? You don't drive down the edge, and if you can't see around the corner, you proceed slowly and with extreme caution!!!!! Not to worry, I will send you a calender every year!!! It was your fault!!

I dunno about anywhere else, but in Texas those dogs are officers, so killing one is right up there with killing a human officer. So I asked my husband, who is a cop, and he said killing a police dog is capital murder, which is a felony. Good luck buddy, you are in a world of hurt. I don't think you will be running any dogs over anytime soon.

Police dogs are considered police officers. It will get a police burial. Good luck, you're going to need it. You don't drive on a street curb. At least, not in America.

No, if it was by accident, you can't be charged.

Sounds like to me you'll be looking at lethal injection for sure

you probably won't be charged with killing the dog unless you were too close to the curb when you made your turn

You could be charged with inattentive driving, speeding, animal endangerment, etc. If you were doing any of thos things wrong. If not, you probably will not be charged with anything. However: in order for you to have a court date, you have been ticketed with something.

The dog is not a human being, so you will not be charged with murder.

that is sad, i bet they know it was an accident and may fine you anyway. it would be absurd if they put you in jail or anything that severe.

Oh man, talk about ur bad luck. Yes, you can be charged w/a member of the police officer, this would be either involuntary manslaughter or vehicular manslaughter. I hope for your sake they go light on you, but this will be a murder charge. Question, was the dog on a leash? If not, if your city has a leash law, you might have an angle. If you do not mind, please keep me informed. soccergirl47546@yahoo.com

K-9 dogs are considered police officers. In New Jersey a law called "Solo's Law" was passed making it a crime to shoot and kill a K-9 dog. The law was named for a K-9 named Solo who was killed in the line of duty

Sorry all that happend to you, but thats funny!!! For a second atleast. If it was on accident, i dont think they would charge you, but then again its was the cops dog so you never know.

Either case, good luck!!!

My guess would be vehicular homicide.

Police K9's are highly trained and highly intelligent dogs. It is doubtful that they were doing anything other than instructed to do. Most likely you were not paying attention or were driving to fast for conditions.

If the court date is set, the charges appear on the paperwork somewhere, I am sure. They must give you advance warning of the specific charges before trial (Patriot Act be damned)

Murder is by definition a homicide. Homicide is defined as causing the death of a human. So no, they can't make such a charge stick.

As far as not being your fault, if the dog was on the curb & not the street, it IS your fault.
