I sold to a minor in a sting... what do I do?
Find answers to your legal question.

I sold to a minor in a sting... what do I do?

So, The craziest thing happened today. We were busy as hell at the liquor store that I work at and this guy comes up, whom I found out was not a guy it was in fact an underage shithead. He Bought a 22oz Busch Ice which even then I should have known something was not right, I mean what kid buys Busch. In the Midst of all the commotion I didn't check his ID. I messed.... So now I have a wonderful peice of paper that says I have a Sitation. My Boss is Irate and I'm pretty sure I'm losing my Job. Its a family run store that is very clean and well known among the city I live in. I guess my question is what do I do? I didn't sell to him on purpose. It was a simple mistake that could happen to anyone. I have to go to court in ten days and explain myself...... what the hell do I do?

well I used to be one of those "sh*theads" before I became a cop, so messing with the kid will only get you deeper in the hole. Yeah you messed up. Minimum fine out here is $187 and goes to about $284. Go to court explain your situation, maybe get your fine lowered. Face the facts and move on with your life.

Tell the judge the story you just posted. People are cited for selling to minors all the time. You will just have to pay a fine, no jail time. One offense is not going to cause the owner to lose his liquor license. The state makes money from liquor licenses, and they don't pull them over one offense.

You didn't sell it to him on purpose, the store was busy, yada, yada, yada. Bottom line is you didn't take the time to verify the age. The court couldn't care less about all the mitigating excuses you have. You're the one selling, so it's your responsibility to manage the activities. Next time tell them to form a line and if they can't wait, tell them to take it back out the door! I'm sure the store owner would rather lose $20 in beer sales rather than the ability to sell any alcohol products for 30 days due suspension.

Do yourself a favor, plead guilty. Tell the judge you were overwhelmed with customers and failed to focus on scrutinizing the I.D. The judge wants to determine if you can appreciate the severity of your screw-up. And, then take your lumps.

pay the fine and don't do it again

tell the truth bro, you messed up...all you can do is tell the truth and throw yourself on the mercy of the court

Chief Yellow Horse
You will go to court and pay the fine. Your employer could face loosing his liquor license so I don't blame him for being a little PO'd.

When you work in a liquor store, your FIRST responsibility is to make sure you aren't selling to a minor.... Doesn't make any difference how "busy" the store is. It is against the law to sell to minors and only takes a moment to check ID.

You will probably get fired. Stores who sell booze to minors can lose their liquor license and/or be closed down. You jeopardized not only your own job but the owners business and livlihood.

Go to court, tell them what you did, bit the bullet and take your punishment....then go look for a new job.

You messed up. You knew something wasnt right, you should have went with your gut and checked his ID

Yes, it could happen to anyone especially when a store gets busy.

I wish I had a good answer for you. If this is the first time it's ever happened to you, you'll probably just get a slap on the wrist.
You could lose your job, but remember...your employer could pay a heavy price for this and he needs to assure the community it will never happen again.

I think you should just be honest and admit you screwed up. Again, if this is the first time the court will probably be easy on you. Good luck.

Plead guilty, face your punishment, and learn from your mistakes.

get off the internet and look for another job :)

tell the truth, you messed up and now have to pay the price. From not on, no matter how busy you are, check the ID's.

For starters, don't sell to a minor again... ya gotta make sure you're checking ID all the time, no matter how busy it is.
You are correct in that you will most likely lose your job - if I were your boss, I would terminate you.
Your employer may very well receive a probationary status on their license or it may be suspended. If they have never had a violation of this sort before, then the odds are in their favor that it will not be revoked.
Go to court, tell the truth like you apparently have here, and pay the fine. You may have to go to a class regarding alcohol sales, ID checking, etc. but nothing big.

well first of all it is part of your job to id people and you didn't. you let the comotion of the moment deter you from doing your job, and now you have to pay the consequences.. you will probably get fined, and lose your job. when you are hired to do a job, your supposed to do it, not half do it,
could you imagine if a doctor only half did his job,
like in surgery,
Oh I was caught up by the moment and I forgot to use the right suture and didn't sterilize,
now the patient is dead..
think about what you do,
before you do it.

We all make mistakes, but only a few learn from them. Use this as a learning experience, take your licks, and be more careful next time. Perhaps your boss will be understanding.

I don't know what state you're in, but in mine, you go to jail if you sell alcohol or tobacco to a minor.

I doubt very many people do so on purpose, because they know it's against the law. So, what I'm saying is that those stings are set up to catch people making mistakes just like you did. They probably chose a time when you were busy on purpose for that very reason.

Yes, you almost certainly will lose your job. And no, it couldn't happen to anyone, because you can choose to check ID's all the time, and not to forget. It also sounds like you knew he was young (you refered to him as a "kid"--what kid buys Busch).

The bottom line is that it's your responsibility to check the ID of anyone that looks young (usually, the law sets guidelines, like under 40 years--check ID.) Being busy or distracted is no excuse, and so you really aren't any different from anyone else who breaks that law. Deal with it, and face the consequences.
