I think my neighbour hit my car - advice?
|
My car has a large dent in the rear wing and a green scratch at rang rover height. my next door neighbour's green range rover has a new dent on its front wing with silver paint on it (my Audi is silver).
She hasn't said anything to me about it or even looked at me since I noticed it.
What should I do, she’s a good friend and I don't really want to upset her. Although revenge is sweet, perhaps I’ll knock its mirror off with a cricket bat and blame it on my girlfriend. (Joke, I wouldn't really do it.....)

I would tell your friend about your car and also point out that funny enough she also has a dent in her car too! This may put her on the spot and she might start talking, if she looks awkward and says nothing then you will know that she is not a very honest friend at all! She seems to already know as you said that she has not spoken or looked at you since. |

As 'Ian UK' said, it's a 'technical offence' for which I always say there are 'technical punishments' which in reality can be quite serious ! Failing to stop and report an accident within 24 hours is a Police matter if you are inclined to report it.
As others have said, you will be suprised how expensive accident damage repairs are now a days so I'd do several things very quickly. Get an estimate, this will help you decide your next steps.
I'd take good colour photos and depending upon what reception you'll get I'd tactfully confront my neighbour .. give her a bit of a face saving opportunity like ' perhaps you didn't notice how much the dink was but would you like to sort it out privately' .. then decide, get a written admission to the effect she wants to settle without going through her Insurance etc.
Try taking the photos with a measure indicating the height of your vehicles damage and try to get similar photos of her vehicle ..and I wouldn't always ask her permission first either if you think she is in denial or its an expensive dink.
If she denies it you could point out that every vehicle manf.s paint can be identified by chemical analysis so the paint on your vehicle, even if you can't get samples from hers, will identify that its Land Rover Green. This is partly how serious non stops are solved by the Police, even glass fragments from head lights etc. can usually be identified to a specific manf. or vehicle, make or model. So when the Special Constable's 'Mafiobos ' his answer says it can't be proved .. well Yes it can, it just depends on how you want to call it and how much it costs financially and in terms of neighbourly relationships. Hint to her that you are so confident that it was her vehicle, if in fact you are, that if she is in denial and you go to the expense of proving it any of your costs can be recovered from her in a civil County Court claim.
Do you have legal protection included in with your Insurance ?
I'm sorry but if that's how my neighbour treated me and my car I just might persue it but I have the knowlege, skills, contacts ..and yes cussidness to do it .. after all money doesn't grow on trees and keeping a car is darned expensive nowadays. |

Unless you talk to your neighbour about this she will always feel guilty if it was her and you will always feel suspicious. Take photos of the damage and go and talk to her about it. She may have been a good friend up to now, but if you don't talk it out it will affect your friendship anyway. |

Just say you're not mad. Make her confess, and call your insurance company.
Be honest with each other. |

I would go and see your neighbour and ask her politely if she knows anything about it. She may not even know she has hit your car or may be embarrassed about telling you about it.
This is technically failing to stop/report a road traffic collision (depending on when it happened) but proving it will be the main issue. |

1st, I would take a picture of the damage to your car and hers. Friend or not, you have to protect yourself.
2nd, I would confront her and hopefully she will confess and you can take care of the damage and move on. If she doesn't confess then I would contact the insurance company and file a report.
If she is a great friend and a nice person then she will do the right thing and how she handles it should help you figure out what you should do. |

Check out how much its going to cost you if it is not that much then forget it. We live in a world today that there is not much forgiveness and everybody is suing each other. Its up to you what you decide but don't use revenge. |

The evidence points to her. Not much of a friend is she? Take photos of her vehicle in the mean time. The repair to your car may cost more than you think! Ring your insurance company, most of them give legal advice, and will advise you want to do. Forensic testing can be done to prove or disprove. |

Go to her house, tell her you aren't mad, but are just hurt that she didn't trust you enough to be able to tell you what happened. Tell her it's ok that it happened, but just that you want to know about it. |

She's probably thinking the same thing ... there's this new dint in her front wing, and you with your silver Audi. |

Challenge her with the evidence and see if the confess up to it, if she denies it without a independant witness you have no way of proving it paint or no paint.
You will need to notify your insurance company, maybe worth doing a quick knock on the other neighbours doors and see if they saw it happen. |

If she's a good friend she'll confess and you won't ask her to pay for it but simply say sorry. |

Ask her politely if she did hit your car. The evidence seems to point in that direction. Take photographs as your insurance company will need them. If you don't want to involve the Police let the insurance deal with it. |

take the high road.. assume that it wasn't her...get your dent fixed and forget about it.... |

I think you should just play a trick on her and tell her theres a traffic warden outside and there lifting the car onto a pickup truck. |
