Why don't you want to go? In many states they will continue to prosecute despite the presence of a victim, according to the statement of charges. Some states will no pros it and others may put it on the stet docket for a few years. |

go to court and see it through. If not for yourself, think of the next woman this creep tries to intimidate. If he gets away with a little now, he could escalate and try to do more and more until someone ends up dead, maimed, raped, etc. You really don't want that on your head do you? |

If you are ordered to appear in court, you will have a warrant issued for failure to appear. If you start something, you have to finish something. If you want to drop everything, you need to find out if that is an option. |

In CA...
If you've been subpoenaed to to testify and do not show up, you'll have a warrant for failure to appear. On top of that warrant, your license will be suspended too. |

They will drop it. The fact that you refuse to go to court leads me to ask if you falsified the entire thing? |

They will drop your case. |

Don't know what the laws are where you live, but more than likely, the warrant will be dropped. Go to court and take care of this problem, or it will only get worse. Now, if you're afraid of the consequences of going to court, you need to make that clear and get a stronger order of protection, or best yet, find a new place to live. Take care of yourself, your children, if you have them, and don't let the cycle continue!! |

Your suppose to drop charges before you go to court, that is very reason police don't like to take domestic call, because you wasting there time |

"I took out a warrant for domestic abuse." What the heck does that mean? Private citizens are not able to issue warrants, and even so, what does "I took out" mean?
Are you trying to say you called the police on someone for domestic assault? That still doesn't mean the courts issued a warrant for someone's arrest.
Warrants are issued by a judge when someone fails to appear for court, fails to pay citations, or has been charged with a crime when out-of-custody. |

The court may go on and hear your case in your absence. But if you do not turn up, then you may also be in breach of court laws. I would contact the court and speak to them. Bear in mind if you just drop this now; what will happen if he comes back and starts trouble for you again.
Will you go back to court? or will you drop all charges as you are thinking of doing now. It may have come as a surprise to him this time, but he may try and call your bluff next time. Think very carefully with what you intend to do. You have over come the hardest part, and that is instigating the court date itself. I would follow it through, no man has the right to make you feel this way.
Good luck and stay strong. |

they'll dismiss the charges if there are no other witnesses |

You should just pay the money to drop the warrant. If you don't show up (depending on where you're located), they may just try the case with whatever evidence they have. |

They'll drop it and it would have been for nothing. |

The will dismiss the charges. Then there is the possibility that the defendant can file a counter complaint to recoup their lawyer fees, court fees, etc. because you wasted their time and money. |

I'm a little confused.... do you mean you applied for and received a temporary restraining order and now have a Court date to attend, to make it a full-term restraining order? That's the only scenario that makes sense to me, given what you said. If that's the case and you don't appear for the hearing, the restraining order will be lifted.
Be warned. If you fail to show up and the order gets lifted, you won't be able to get another one until he becomes abusive again. You notice I didn't say, "unless" he becomes abusive. This is the cycle of domestic violence... he's playing nice right now becuase he KNOWS you have to appear for the hearing in order for the order to stay in place. If you don't want to have contact with him in the future, you need to be in Court. If you don't show up, he's going to think he can get at you again... and he will. |

If you don't show, they will drop it. |

Most women recant after spouse buys them a pizza.
The judge is in charge now and the courts are well aware of the emotional conflicts of women in these cases. |

Charges will be dropped. Are you sure this is the right choice?
Good Luck - and take care of yourself. |

They'll drop the case but you will be putting yourself in a very powerless position for the future should this ever be a problem again.
I would call the court and cancle your court date.
Not appearing in court is always a bad call. |
