I want to know the laws about following a person (UK)?
|
I want to know if I am allowed to follow somebody when they are in their car, I will not make contact in anyway, letters, etc. So far they have reported me to the Police and the Police have warned me to stop. I just want to know if they can do anything to me, if so I stop, if not I continue. Thanks.

In England and Wales this is an offence of Harassment.
As stated the offence is complete if you have pursued a course of conduct which amounted to the harassment of another and which you knew or ought to have known amounted to harassment.
In reality you cant dispute 'you knew or out to know' that your conduct ammounted to harassment as the police have told you it does. They will give evidence to this fact in court.
All the injured party has to prove is that you continued to follow them. This can be done from CCTV, Witnesses etc.
Do it again, get arrested. |

Oh yes. They can have you charged with stalking and harassment. |

I think that counts as stalking. why are you following them? and you can have a restraining order put on you to keep away from them, so i would stop. |

Anti stalking laws exist in a many forms, it is often reffered to as criminal harrassment. The victim may feel in danger and has the right to have the stalker appear before the courts once the victim has filed a Information and Complaint. Unfortunately the anti stalking law is lacking the required teeth to ensure that the stalker cease and desist.
Let me say this, men are also stalked and is not a gender issue. |

Since the police have already given you "the warning" you now have one very big problem. If you persist the police have considerable powers to arrest you, throw you in jail and throw the key away.
In the case of a 'stalker', which is what you are, you, the stalker, gets one warning. Next time you are arrested and charged.
Let me be absolutely plain about this. The Judges of England take a very dim view of the sort ot thing you are doing. It has often lead to murder. You will be treated as a criminal, which is probably what you are.
The only people allowed to follow other people about are the fuzz and certain licensed detective agencies who are well known to the fuzz and highly responsible.
Take my free advice. Stop what you are doing.
I'm talking from personal experience. I had a stalker just like you. I told the fuzz when I found out where he lived. They spoke to him. He never bothered me ever again. In effect, he is not even allowed to come within a mile of me and if seen will be arrested. That order stays in place. |

It's called harassment whether you talk to them or not. That includes driving right behind them or following them. Unless you fancy your dirty washing being hauled through the courts, I'd pack it in.
All you're sounding like so far is a complete wing nut. That is, an ear on either side and sod all in between. |

Why would you want to do such a thing, it's intimidation, pure and simple.
Where there is cause to think the person is a criminal, with evidence to support such a claim, then go see the police.
Strange people. |

Can you tell the readers why you have taken it upon yourself to stalk a person in spite of the fact you have been warned to stop by the Police?
Are you indicating to the readers that you have no respect for the police and the law as it stands regarding stalking?
Asking advice on this forum will change nothing. You should take heed of police warnings and refrain from not only causing anxiety in your victim through such despicable act, but also obeying the law as must have been explained to you by the police. |

In scotland if you continued you would most likely be charged with a breach of the peace. This could result in a fine or a summons to court. |

Do you mean in England, Scotland, Wales, Northern Ireland? it varies. |

I won't lecture you on this but answer it as factually as i can.
I take it your warning will be your 1st part/case harrasment warning which in case if you continue to follow this person then you will be arrestable for harrassment which could lead to you being charged and jailed for up to 6 months in prison.
The law states :On **(..DATE..) at **(..TOWNSHIP..) pursued a course of conduct which amounted to the harassment of **(..SPECIFY PERSON/PERSONS see note iii..) and which you knew or ought to have known amounted to the harassment of
(A)_[him]_
(B)_[her]_
(C)_[them]_
Harassing a person may include alarming or causing the person distress; a "course of conduct". Meaning that if this person is upset that you are following them around in there car then you are ALARMING or CAUSING THEM DISTRESS/UPSET, any reasonable person would not like to be followed around by someone would they and it would upset them, especially if they have had issues with you in the past.
So yes, follow them around and this person makes a complaint , you will look at being arrested and interviewed for harrassment, if you are charged will depend on the evidence. |

Stop straight away. They can do you for stalking and if you have already been warned by the police then I hope they do. No one likes every moved they make being watched by some one. |

I guess you must have a reason for following this person, but if the Police have already warned you I would stop otherwise you could end up in serious trouble. |

I guess it is not for a good reason since the cops gave you warning. So, I would stop. |
