I was arressted for missing a court date, when I go back to court.. will i go to jail?
|
In feb. of 2006 I was pulled over because I worked over night and was feeling sleepy on the way home, so when the cop pulled me over I was hit with wreckless driving. I never went to court for that due to my job.
This year May of 2007, I was pulled over again, my license was expired and my license was suspended, so I got tickets for those 2 offenses. I was also put in jail because I missed a court date of last year for the other offenses. Keep in mind that I have not yet paid any of the tickets yet. I have to go to court on the 12th of this month(June). What should I do, and do you think they will put me in Jail?? But I'm bringing some money to put towards my tickets also, and a friend of mine told me to plead 'No Low'?? Advice please...

Get an atty. Jail isn't a sure thing; but with suspensions, they don't have much else they can do but give you a few weeks. |

make sure you have enough money to pay for the tickets, the cpr costs (usually £34) and any fine that the magistrate is likely to impose, you shouldnt get custody given that you have not commited a violent offence and the prisons are over flowing. chances are you'll lose your license, pay a fine and get a community sentence, if you do anything again you wont get bail because you didnt turn up for court so they would remand you to appear at the next available date. dont wuss out on the community sentence either because if you miss it, they will bring you back before the magistrate and they will resentence you and would then look at custody.
Good luck on the 12th, plead guilty at the first opportunity and you get less of a sentence as you dont waste everyones time. |

Better look towards getting an attorney on this one. Might cost you some money but he/she may be able to plead the case to the point that you may not have to do jail time. Going with out help may be setting yourself up for some time. I would at least see what an attorney says. |

Saying it was because of your job will not fly. The court expects you to be there no matter what. The fact that you were sleepy won't either as you have lost your chance at argueing that.
The driving on suspended will stick as a person would assume that their license would be suspended after not showing in court. But it will say on your driving record if you were actually notified of the suspension...... so if you moved, the address is different on your license or something you may have something there. The expired license will stick as well.... it will look like you did not renew it because you knew it was suspended.
Failure to appear, suspended and reckless are a really big deal. It is a combination that will certainly result in huge fines, jail time and a suspended license. Not to scare you but thems the facts. You could face suspension for 10 years...... or if that did not happen one reckless, DWI, driving on suspended, etc. certailnly will.
Forget taking money to court as if they just let you go you can make arrangements to pay. You need to absolutly take that money and/or get money anywhere you can for a lawyer. It will be worth it in the long run. |

I doubt they will send you 2 jail.
If anything they could ban you from driving for 6 weeks or anything up to 6 months.
And you may get a hefty fine. |

Your friend is advising you to plead No Contest. I can't spell it in Latin, but it sounds like Nolo contendrey. What will happen is dependent on many things, such as what the laws are where you live, what mood the judge is in, etc. I am not an attorney so it would be illegal for me to advise you what to do. I will however tell you that many years ago in Florida, I went through a very similar situation. I came to court dressed nicely and was very respectful. I plead "no lo" and I brought money to pay my fines. I was let off with time served. If this is the only thing that you have done, and all else is well, I hope that the same thing happens for you. I would say Good Luck, but luck is not a factor. I will wish you happiness my friend. :) |

sounds familiar to me. best advice is to hire a lawyer. do not try to handle this by yourself. |

it depends on the judge. if you explain your situation and can show you are willing to pay the fines they may be a bit more lenient but i would get a solicitor |

not for the missed date but for driving on an expired licence and therefore no insurance no tax as all invalid.
dont tell them you have any money, theyll fine you xxx+ what you bring, theyre mean
sort your life out, you could have killed yourself or someone else driving like that, no job is worth death or murder |

I don't know or really care whether you are in USA or UK or anywhere else in the world but I f I was the Magistrate, Judge or other person with such authority, your action, or lack of it, would lead me to the opinion that you were irresponsible and deserving of a custodial sentence, followed by a ban from driving for a substantial period.
Your complete disregard for human life by your action in driving recklessly and while suspended, coupled with your failure to comply with documents handed to you would be sufficient to warrant the penalties I describe. |

Yes I think they are going to lock u up. If you would have just went to court the first time then they would have just let go. with community service or something but u let it go. then was pulled over again and got two more tickets.but if you bring ALL the money for the tickets they might let you go. |

1st ticket..fine, failure to appear..fine,
wreckless..fine, driving susp...fine...
ins.? some money...you better bring a bunch...jail time , ask for a suspended sentence, fines , pay what you can and ask for time to pay the rest. dont make excuses......or ramble. |

That depends on your criminal history really. But in reality, you'll just get a fine and have your license suspended or revoked for a while longer.
Plead guilty, believe me. |

theres a posibility u could go 2 jail............but who knows with the state the law is in!!!. |

This is a minor offense and most likely you will not go to jail if you are prepared to pay your tickets. However, if you miss this court date another bench warrant for failure to appear will be issued and you will be picked up again.
If you do get a bench warrant out for your arrest, the best thing to do is turn yourself in. They won't usually hold you over 24 hours in traffic matters. |
