I was cited for speeding.. and I want to contest it. Read description for more info.?

I was cited in a 35 mile zone doing 57 and the officer lowered it to 52.

Some background facts to aid the answerers in provided adequate assistance:

I am 16 years old, birthday in May.

I have been stopped 3 times (including this one).

1st. 54 in a 35. Citation issued. Judge revoked it.

2nd. 62 in a 45. No citation issued. Verbal Warning.

3rd. 57 in a 35. Officer lowered it to 52 in a 35. Citation issued (Current citation)

I know I am lucky to still be driving, so don't point out the obvious and I know I must slow down before I hurt myself, someone else, or get my license taken away. So please, aid me with my question, and not critize me on what I have previously done.

What I want to know is if there is anything I can do to contest this. The evidence *I* feel *I* have is that we asked for a radar accuracy test and the officer (Georgia Sate Patrol) denied it.

Also, the road I was on, is a 4 lane highway with a center divider - and is 35mph. When another road in town is 2 lane, no divider and HIGHLY residential - is 45 mph..

Advice on what to do??

Stop being a smart ***, which probably why you got the ticket in the first place, the officer gave a brake by lowering the ticket, since a certain amount over the speed limit is considered reckless and usually does not qualify you for defensive driving! Most radars are calibrated every 3 months, he does not have to prove to you that it is accurate while conducting his business with you, you have to prove it was faulty in court, which is a waste of time! Pay the ticket and slow down or at least keep your mouth shut while being issued a ticket!

First, your defense so far is based mainly on the fact that you don't want a ticket, not anything that will influence the judge.

It may seem improper, or at least not the smartest thing, for 2 roads of different designs to have speeds that logically would seem to be reversed from what is expected. However, that doesn't make any difference to your case. Highly residential may not have the same traffic count and the number of traffic turns that the more business one does. In this case, if you want to correct this situation, you will pay the ticket and then lobby the appropriate agency to change the limits for the future. No, you wouldn't get yours rescinded either.

Second, you have obviously read somewhere where a person asked for a radar accuracy test and since the cops couldn't produce anything recent, the person got away with the speeding. However, most departments do now keep records of the tests and calibrations of their unit. To imply that they have to be tested after every ticket would be too burdensome. Again, they will have documentation to show that they are maintaining the units regularly so that will not work either.

So, in effect, you have had two chances to learn your lesson. It would appear that this time you will be found guilty. Perhaps this will get your attention this time. Sometimes the only way to get a change in behavior is to change the amount of money you have to buy gas and then drive like it is free.

It doesnt make a difference if its 2 lanes or 4...u must drive the speed limit. Driving is a privilege not aright,, so pay the fine and take responsibility.

You already tried it - don't bother fighting. It's your word against the officer's, and if that first citation is on record you certainly won't get the benefit of the doubt, especially at your age. Don't bother arguing against the speed limit either - there's nothing there that will save you.

Show up, plead guilty, and hope you get leniency. There's a possibility that you might currently have a clean record - it depends on whether your previous dismissal and warning are on record. If it is still on record, cross your fingers and hope for a driver's ed class.

And stop speeding. Not just because of tickets, but you're speeding in residentials where you could kill animals or people. Going 15 over on the interstate isn't nearly as bad as where people are potentially walking across the road.

What you should do is:
Pay your fine.....be thankful you're not out hundreds of dollars more (at the least)
and slow down.


If you've been caught 3 times......you've probably gone those speeds.....about a thousand times?
