police woke me up I asked for breathalyzer said I had not participated. I really did not have anywhere to go as we were in a rental house 4 hours from home the adult chaperones were in their room with the door shut so I went to bed at 11 police came at one am and ticketed everyone in the house for possession of alcohol I was the only one not participating. I cannot afford lawyer should I go to court and plead not guilty?

the chaperones were a mother (age 50) and her mother (age 72) the police did not give anyone a breathalyzer I was the only one asking for proof to show I had not been doing anything. I believe it is a huge money maker because about 19 kids plus the 2 adults were given at least 2 citations each totaling about $20,000 n fines. The officer acknowledged I wasn't doing anything but being in the wrong place at the wrong time. Maybe they won't mind letting one innocent person get off since they are getting so much $$$ from everyone else. So should I plead not guilty and ask for a trial date?

Notice that the charge is "possession," not consumption. As to how to plead, it is your choice. Courts exist to conduct trials and determine the truth of an accusation and you are free to contest any charge you wish. Plead not guilt and set a trial. At that trial, bring all your evidence and witnesses. |

From what i understand...if your breathalyzer test is anything above 0 and you are underage you can get ticketed. There is no such thing as chaperons. They can be ticketed for distributing alcohol to a minor.So where was the alcohol when the police arrived in your room??The only way to fight this is the get the breathalyzer results to show 0 and prove that the alcohol was not near your body or possession. What did the chaperons do??? Don't tell me the chaperons were just some friends that were over 21 that you were hanging out with from college. |

Based on how your side of the story is, unless you had been drinking or in immediate control of the alcohol (meaning in your vicinity), I would plead not guilty. Apply for a public defender if you cannot afford an attorney. |
