I was just wondering if a police officer pulls you over for speeding and you know matter of factually...?

that you were not, what are you're rights? It seems as though the justice system works backwards, one is guilty until proven innocent. I was pulled over for speeding but I had my cruise control set for 70 and he says I was going 80. What do I do?

Also I think I was stereotyped bc I have a new model mustang, however, there were many cars passing me on the highway including a ford focus who was probably the car he clocked. The zone was 65.

You can fight it and have every right to. The burden of proof is alot lower when facing a traffic ticket then a criminal charge.
There are explainations as to why your cruise control speed and radar speed differed. One, the radar has an accepted error of about plus or minus less than 4 km/hr (I can't remember the exact number right now), which is slightly higher in MPH.
Second, your speedometer may not be calibrated correctly.
It is possible you were doing more than seventy (even on cruise control) but less than eighty, BUT
Bottom line is, when you get before a judge and testify that you were doing 70 instead of 65, he will find you guilty. I have seen it happen more than once.

You can contest the ticket, that's what court is for. You could have also asked the officer to see the radar gun reading. You are innocent until proven guilty, but you need to be aware of your rights too.

Also, be carefule arguing that ticket. What was the speed limit? If it was 70, then ok, but if it was 65 the judge may ask you "Yes, but were you still going 70 in a 65?". Could backfire so watch out.

You are right about one thing, driving is a privilege, not a right, so the court works in favor of the police. Take it to court and make him show the radar and explain how it works and how he arrived at deciding it was your car doing 80.

if you can prove that you were not speeding then you can fight the ticket by asking for a hearing..
the only thing about this is that it would b almost impossible to prove that you were not..
sometimes a vehicles speedometer is wrong causing the vehicle to travel at a faster rate than the speedometer actually reads..
if you want to fight it, it would b a good idea if you had witnesses in the car with you..

The ticket is an accusation of a crime. Only an accusation. If you wish, you plead not guilty and set a trial. At that trial you will be presumed innocent and cannot be convicted unless the crime is proved. You will have the opportunity to confront the witnesses against you, and to cross examine them. You will have the right to testify or not to testify as you wish. At the end of the trial the court will determine whether the charge has been proved. BTW, if the evidence shows that you were doing 70 in a 65 zone, that is a crime. It is the same crime as doing 80 in a 65 zone.

You would need to prove that your cruise/speedometer were accurate. And if the limit was 65 then you end up with an admission of speeding. Seems a lose/lose situation.

You pay the ticket, sadly there just isn't anything you can really do. Sure you can take it to court and fight the ticket but considering the time it would take to do that you are better off paying the ticket. Sounds like you've been had buddy, just some cop trying to meet his quota.

tell the judge in court. he will most likely dismiss it.

dispute it in court and make him prove it and call the station and fill out a complaint....if this officer is doing this then others will have done that and the more people that follow through the more credibility they have and the better the chance he will be reprimanded
