First of all, I love this Tattoo guys answer. He is right on. Do you think that police officers have nothing better to do than "harass" innocent citizens?? Believe me when I tell you that there are WAY too many real bad guys for me to go "harass", to just pick innocent people out of the blue to "harshly handle".
You left out a big portion of this story. What did you really do to get the attention of the police? Now be honest. I've heard this story way too many times. And like Tattoo said, if you were not in-custody AND under interrogation, then you don't have to be advised of your miranda rights.
When you are ready to tell the ENTIRE story, then you will get a real response, with real advice from the Yahoo community. I just love all these sue happy people around here. No wonder the world is so un-trusting of eachother. |

Look on the bright side.

You need to tell the whole story. Nobody get's arrested for "No reason." |

If you truly feel you were arrested for no reason and abused, get a lawyer and let them deal with it. That's what they get paid for.
I don't think all cops are dirty, but I am experienced enough to know that some are. Your accusations will be tough to prove, so be sure of your facts and evaluate whether you want to deal with the hassle and expense of pursuing it. |

You are leaving too much out of this question. It almost seems that you are making this up.
If you are arrested, then you are charged with something. They can not take you to the jail and book you in without having any charges. They could have detained you for questioning, but no real cop would have done that without advising you of your rights. That would for sure be a lost case if he did that. If you were arrested then you need to be magistrated, and part of the purpose of being magistrated is to advise you of your rights. So if the officer made an honest mistake and forgot to read your rights or if you were too drunk to remember, the judge that magistrates you does.
Not trying to call you a liar or anything, just pointing the big parts of your story that don't add up at all. |

You should get a lawyer and straighten this up in the court, but if the treatment wasnt too bad at all just forget that... |

If what you say is right, and you are telling the whole story, then file a complaint with the internal affairs division of the agency that arrested you. If you feel like that will go nowhere, especially if the agency is particularly small or rural, consider going to a state investigative agency or the FBI. Don't bother with a lawyer unless there is real evidence that they did something wrong because otherwise you may throw away your money hiring the attorney for nothing. Cops who are sued often have pretty good attorneys on their side. |

Get a lawyer and sue.
Then buy yourself a beautiful house and a really nice car and live the good life for the rest of your life. |

You potentially have a big case against them although if there were more than one of them and only one of you with no evidence, the police will tend to be able to manipulate things.
Not sure about in USA but there must be some group within the police force that you can lodge complaints, get a lawyer and get his/her advice first |

Get in contact with that police department's Bureau of Internal Affairs. If that doesn't work, seek legal counsel and alert the media...they love this kind of story! |

The first thing you do is write down the incident from beginning to end. The second is find witnesses to the incident. The third is to make a formal complaint to the internal affairs dept. of the police dept. where you were abused. Then contact the trial lawyers assoc. of your state and find an atty. that specializes in police misconduct. Realize however that without injuries an atty is not likely to be interested in your case unless you were hurt physically or if the officers involved have a history of misconduct. |
