You're wrong about the charge twice. It's not robbery, it's retail theft, and it's not a felony, it's a misdemeanor.

Well, to clear up a lot of wrong answers here. There IS a crime of theft in California, both petty theft ($400 and under) and grand theft (over $400). There is also a crime of robbery, which is taking property by means of force or fear. However, in California there can also be a robbery if force or fear is used to prevent recovery of the property. (This is called an "Estes robbery," after the case which approved the charge.)

So, if force or intimidation was used against the security guard to prevent his recovery of the stolen booze, it can be charged as a robbery. Moreover, since the plan was obviously to enter the store to take the booze, it could also be charged as a burglary.

Although these boys are old enough to be prosecuted as adults, if they have no records it is most likely that the case will remain in juvenile court. It is always difficult to predict what might happen there, and a lot will depend upon what charges are ultimately filed as well as the information presented by the investigating probation officer. You will get far better information from the attorney appointed to represent the minor.

In Ontario Canada, robbery is considered theft with violence. If the boys pushed a customer or an employee out of the way to escape with the booze that would be considered robbery. If they just grabbed it and ran without touching anyone it would be considered simple theft here. I will let my American colleagues deal with the penalty portion of your question.

if yuo steal something it's theft. really all would be charged because if you are with someone who stole something you would be charged as well.

I thought robbery had to involve intimidation. And, depending upon the amount stolen, should this not be a misdemeanor instead of a felony?

Bottom line: California is a crazy state with a government full of control-happy posers, and there is no telling how many goofy trumped up charges are involved in such an incident.

There is no crime called theft. That is a generic English term for taking stuff.
Robbery is taking something from a place or person. Aggravated robbery is using a weapon or implying use of a weapon by issuing a threat. There are other levels depending on amount taken.
Shop lifting is taking something without paying for it, but this was (apparently) an organized robbery. All involved are charged with the same crime.

NOTHING will happen i have done much worse and i never even went young offenders they definitely wont go jail it probably wont even go to court but you might get a very small fine .Go to bed and dont worry

It will be premeditated charges. They will probably end up in court, but I doubt any serious jail time. Most likely community service, fines, and probation.

I'm sorry I don't understand your question It is robbery if they steal something from the store the fact that boy B didn't have anything in his hands does not mean he wasn't there to steal if he is a good lad then he should drop his so called friends who left him to face the music and help the police with their enquires

I'm no legal expert, but I would imagine it would probably be for assisting robbery, or something like that. He could probably get a plea deal if he turned his friends in, though.

they will prolly do some time for stealing and underaged drinking. but they wont be in jail for like a year. prolly like 3 months or sumtin.
