Until you are 18 years of age, you do not own any property. Anything you have, regardless of who paid for it, belongs to and is the responsibility of the parents. |

i made my daughter take the cell phone back and had the company void the contract she sighed. why i made her take it back? in about 5 months she ran up a huge phone bills, she was making long distant calls. we went to court and the judge ruled in my/our favor for obviously reason. |

A minor cannot enter into a contract. If a 16 year old enters into a contract without letting the vendor know they are under age, the contract can be called null. If the parent finds out, they can force the child to return the cell phone and can force the vendor to return funds paid. The vendor cannot sue the child or parent in most cases.
There can be some exceptions if the minor committed fraud in order to get the cell phone (ie fake id and stated over 18). |

It is her property *and* her parents can take it away from her if she's misusing it or if it's interfering in her life in some way. Are you going to call the police and report your parents for theft? What if your parents rescind their permission for you to work? (Or whomever) |

CAN A 16 YEAR OLD GET A PHONE INSTALLED IN HER HOUSE? PRIVATE LINE?IF SHE PAYS FOR IT BY HER SELF THEN SHE HAS A CONTRACT WITH THE PHONE COMPANY TO USE THAT PHONE.
I THINK IT WOULD BE A GOOD WAY TO ESTABLISH A LINE OF CREDIT.
IF SHE LISTED HER PARENTS AS RESPONSIBLE PARTY THEY MAY HAVE A LEGAL RIGHT TO TAKE THE CONTRACT AWAY?
UNDER LAWS I HAVE RESEARCHED, SOME STATES ALLOW A CELL PHONE TO A MINOR WHO HAS THE ABILITY TO PAY? |

If she pays for it, there's nothing really the parents can do.. If it was a regular plan under the parents' name, THEN they have the right to confiscate it.. other than that, it's hers, she pays for it. |
