If a cop stops you for no seat beat by law does he have to write me a ticket or can he just give a warning?

he can just give you a warning, he can give you a ticket, or since a ticket is given in lieu of an arrest, he could arrest you....its officer's discretion

there is no law that says an officer HAS to issue you a ticket

A police officer always has the option of not writing a ticket and only giving a warning.

Now some departments may have policies that everyone be written a ticket. There is a current national safety program called "clik it or ticket" those officers that agree to be part of the program basicly promise to ticket anyone they find

"By law," it is a ticket-able traffic offense. If he gives you a warning, chalk it up to your good fortune and say "thank you." Better yet, just put the belt on when you get in the car...it really can save your life.

He should write you a ticket. But it's up to the individual cop, he might let you away with a warning if you're lucky.

In the UK, they are supposed to give you a ticket. 75 pounds, about $130 these days. If someone under 14 is in your car and doesn't have a seatbelt on, the driver gets the ticket. If over 14, the person not wearing the seatbelt gets the ticket.

I've never heard of anyone not getting a ticket.

It's completely a judgement call, that stuff about being in the computer is only accurate if the agency you get pulled over by actually uses a computer system to track things like that. As far as not being able to stop for no seatbelt in florida, thats bull, I have and regularly do stop people (i work in florida) for seatbelt infractions, and quotas do NOT EXIST, they are prohibited in most states

he can write you a ticket, but pray for a warning because a warning doesn't go onto your record and therefore will not raise your insurance rates.

He can do either. Here in Florida he has to have another reason to stop you...Then nail you on the seat belt...Not wearing my seat belt helped me once though. I was speeding and was pulled over. The cop said that he was going to give me a warning for not wearing my seat belt and I got out of a $250 speeding ticket....I only had to endure a lecture on what could happen if I have an accident and I'm speeding and not wearing my belt.

I doubt if he has to write you a ticket, and I believe in many states you cannot be stopped for no seat belt as the primary offense.

For many things you will not get a break. In my state the State Police will write you up for a DUI if you are the President of the United States.

We only have a seat belt law for minors.
