Criminal damage.

Although they have not carried out an actual act of damage they would be deemed (as per the definition of the offence) to have been reckless so as to cause criminal damage.

I have to agree with Warmonger. If it was me I'd definitely push for attempted assault because of the fact if the driver got in to the car, got on the highway and had a blow out they could of been seriously hurt.

It's not clear whether or not the tyres are actually damaged by the placing of the nails, or whether they will only be damaged when the car is driven away. Also, you don't state in which country this takes place.

So the answer to your query is as follows...

In England & Wales, if the tyres are damaged, it's criminal damage, contrary to Section 1(1), Criminal Damage Act 1971. If they're not damaged, it's an attempt criminal damage, contrary to Section 1(1) of the Criminal Attempts Act 1981.

There's an aggravated form of criminal damage if a person causes it "intending by the destruction or damage to endanger the life of another or being reckless as to whether the life of another would be thereby endangered", contrary to Section 1(2) of the 1971 Act, but on the bare facts given, I don't believe that there would be any chance whatsoever of a conviction.

In Scotland, it would be Malicious Mischief, contrary to Common Law, whether damage to the tyres was caused or not.

I don't know anything about the relevant law in Northern Ireland, sorry.

vandalism and/or property damage- if caught and go to trial- you will have to pay for damages and court cost- prob get some community service out of it also

But I would imagine they would be charged with vandalism, and maybe even attempted assault.

That attempted assault charge would probably be pushing it, but I think it could be justified legally by saying they were modifying a deadly weapon (the car) that if used would endanger the driver.

But I'm fairly sure the vandalism charge would be coming.
