If this is in your home,
You'd have done one thing right. Make sure there's only one side to the story.
Tell the police he brought the gun, and you got it away from him, and then he had you cornered and on the floor, and came at you with a weapon, saying he was going to kill you.
(stage the situation as necessary, cold knife-broken glass-position, prints-etc.)
That ought to absolve you almost anywhere. You'll lose the gun, but so what? You're still alive.
If you're "carrying" in public w/o proper everything ... the Police & a jury of your peers will turn a victim into a suspect, and convict YOU for either, owning a gun illegally, carrying a gun illegally, having an (if hot) illegal gun (they heap it on-plea bargain down-get as many as possible to stick), disturbing the peace, public nuisance, child/civic endangerment, not running away, or giving him what he wanted and then calling 911.
Yes, many times even giving him his beat-down of you, or your death.
They'll make the case of how did you know for sure he was going to kill you? ...
It is a pussified world at times, especially when it comes to guns. Self defense is not enough any longer, you have to have NO other options, or be protecting others (your wife/children), and cornered/otherwise disadvantaged, and in your own home.
Property is no longer a reason in many States.
If on the North East Coast ... Forget about it!
It really depends on where you are. You can go on the web and find the laws for where you are. If you acquire the gun illegally, transport the gun illegally, or possess the gun illegally, duh, you are illegal. Once you are originally illegal, any action taken against another (whoever), will be your fault, as you went looking for trouble, packing.
Own a gun the right way, or it's you the laws are protecting us against.

Maybe. More than likely, but as I always say - it's better to be judged by 12 than carried by 6.

If this scenario ever happened, cop to a plea deal. Or take the case all the way to the Supreme Court challenging that a Right, guaranteed by the 2nd Amendment to the Constitution, does not need a permit.

Depending on what state your in... In some you can own a gun, have it in your house, but cant take carry it on you or conceal it. So it really depends on what the laws are in your state. Im in FL and you only have to be 21 to buy a gun, 3 days cooling period and its yours. Getting a carry and conceal is another story.

& really in the end dead guys cant testify so...

Depends on where you live. Most states don't require gun permits.

If you illegally acquired the gun. You could stop a bank robbery with it. They will still charge you for having that gun. So be smart if you do decide to get a gun by the method I mentioned above.

In most areas of the US, you don't need a permit to buy a gun; especially true of a long gun purchase. Pay your money, wait for the 'instant' background check, and go home.

In the scene you describe, you might have a problem if you are not permitted to use a weapon to protect yourself in your home.
A good lawyer and sensible jury are good things then.

In any event, you are open to civil suit if you shoot someone.
