Im a Police officer..The police vehicles that all officers drive have to be checked by every officer that gets behind the wheel of that vehicle. It could of happened whislt driving as its only normally a bulb. From my experience when at night and having your lights on you will know if you have a headlight out. I would of made a joke of it..and normally I ask people to
'slap' their head light as sometimes it can be loose contection and it comes back onto a normal beam. I would certainly be fair about it and sometimes you get huge respect..even from the boy/girl racers...Come on be fair!!! |

I would say that in lieu of being cheeky and pointing out their obvious defect, you may have a better chance of getting away with a slap on the wrist. |

Yes but I doubt you will be prosecuted. They will just tell you to get it fixed asap. |

Well, you wouldn't be prosecuted for a defective headlight. You might be ticketed if the cop were in a really bad mood that day. You'd probably be let off with a warning.
But yeah, you'd get in trouble for it even if the copy had a broken headlight, too. Why? Because his crime doesn't detract from yours. If I lie, and you lie, and I tell you that lying is wrong, it doesn't mean that I'm incorrect. I'm right that lying is wrong and I'm right for telling you that you're wrong to lie, I'm just also a hypocrite. At worst the cop would be a hypocrite, but you still broke the law. |

yes or they give u about a week or 28 days to get it fixed |

Yes they can as you have broken the law. However, here in the UK most Police officers will issue you with a form allowing you 7 days to get it fixed and then present your vehicle at an MOT testing station for the garage to confirm you have fixed it. You then send or present the form at a local Police station. It does not matter the Police vehicle has a defective headlight as well. Most Police officers care about such things and wil fix their own light as soon as they can. Also if you continue to drive when lights are required with a defective light you may find your insurance company may not be very sympathetic if you have an accident and may they may choose to limit their liability. |

This is one of my favorites! With all the obvious crime with drugs being sold on the streets, kids shooting and stabbing and jumping others and reckless driving , I see it all everyday, I drive a school bus, I will see people being pulled over that are mature respectful looking people driving through town and down the street I will see a car full of people driving like maniacs by schools music so loud they would never hear a horn or siren reckless. You tell me? |

Yes, sorry, they would not prosecute you for defective head light unless you have been warned previously or you gave them lots of attitude when they stopped you. If this was the first time you knew about it and the first time they stopped you they would just warn you of the defect and ask you to make the repair as soon as poss, normally in 48 hrs. if you been stopped before about the light or gave attitude when stopped then yes the police may give you fix pen for this. I'm afraid it does not matter if there vehicle is defective as long as they to got the problem sorted ASAPP. |

Absolutely. To the fullest extent of the law. Hope you get some prison time too for asking such a dumb question. |

Of course they do, you are not a member of the Policeforce, maybe someone
tampered with their vehicle, maybe their vehicle was not serviced because they had been out working... |
|

Of course they can. But if you get your headlight fixed prior to the court date on your ticket, and show the Judge the receipt, it will likely be thrown out. |

The thing that virtually all answers missed is, not a violation of law issue but a safety issue. I was pulled over for cutting someone else off many years ago and to my suprise, the guy I cut off only had one headlight and caused him to appear to be in another lane. I explained that to the officer and that was the end of that. However, it could been tragic.
Don't get your back up over being pulled over for not having a headlight, two bits says the officer did not know about his either. Driving in a highly lighted area makes it difficult to tell.
He stopped you for your own safety |

Of course you can be prosecuted but it is unlikely if your car is in good order they would normally give you a warning or a form requiring it be repaired in a fixed period.A good tip is to always say you checked at the outset of your journey which is the defence they will be claiming.Police officers are human and would be so embarrased that their own light was out they would not bother you further.I once got out of a police car to tell a driver he had a light out.The driver was apologetic and said'im not being funny but your front wing just fell off'When I looked back at the police car there it was resting on the wheel. |

You're not being prosecuted, you're being cited. Officers have to make sure their vehicle isn't in violation also. I'm sure their squad was repaired immediately. How long did it take you to fix yours, and do you have a receipt?. You have a defense if you can show you corrected the violation right away, and be able to prove it, but to say, their headlight was not working either, sounds as if you're passing blame. In other words, if they can do it, why can't I?. |

Why don't you donate to the Police, to help them buy better equipment while they keep you safe. |

Sure, it's like asking can police speed to catch me if I'm speeding? Get it fixed theirs no points. |

errrrm yer. Just because they have it doesn't mean it is ok for you to. As they are human if you tell them and say that they might let you off itf you promise not to prosecute them! try it! LOL :P |

Babz

Yep its do as I say not as I do ( lol)
They would normally give you a warning and say go and get it fixed, also you are in your right to warn them that theirs is also faulty likewise. ( not sure if this will make you very popular with them! ) |

Take a picture of the front of the police car showing the headlight out if you have a camera phone & bring it to court with you. |

you should have asked for a supervisor...made him write a citation for his officer...i did it once...and it worked...they left me alone after that...you can make a citizen arrest...same concept |
|

yes they do unfair i know but they are the upholders of the law and you are only an ordinary citizen |

Two wrongs don't make a right. If a cop breaks the same law as a civilian, then both need to be prosecuted.
Having said that... maybe the cop car's headlight got busted because he was in a high speed chase and banged his car against a pole or something just before pulling you over.... |
|

Ogbunigwe

Yes ,they have the right to prosecute you and you hve the right to ask your lawyer to sue them for same offence |

In theory, no, it doesn't seem right for someone to proscecute you for a crime they, themselves are commiting. But, knowing our police force, they'll probably proscecute anyway. |
|

I hope not, but the police are all crooked anyway and they will make stuff up (little additions to the facts) in order to justify pulling you over or taking you down the station. I can understand why they do it, their is so much performance management and so much procedure that they feel they have to protect themselves and their career. But they are still all full of rubbish when it comes to filing their reports. |
