I'd check with a lawyer in your state on this. My instinct would be to say no, but it may be possible depending on the statute of limitations in your area. |

They could sue, but the proof of evidence would be almost impossible to prove. If I were on the jury, I would wonder why the person who was in the accident failed to get the report only to claim damages 3 months later. It would look like fraud to me. Even insurance companies would most likely deny the claims after this length of time. |

Good luck with that!!! It maybe to late, should have reported it as soon as it happened. Hopefully you have eyewitnesses so if you take this person to court they will be able to help you out. |

You can make a police report but you wont be able to sue All claims are judged under a scheme call QLL that sets down criteria for a claim to be pursued as you didnt report it staight away and wasnt serious enough for the police to be call then you dont have a QLL qualifying claim |

no you must get the report at the scene. did anyone go to the hospital for any injuries. if so there might be a case .depends on the insurance companies |

Depends on where the accident was, and the local statute of limitations.
In most places NO you wouldn't be able to claim after that time, mainly because all evidence will have gone so the courts/insurance company would just throw the case out.
After all there is no evidence that the person who was suing wasn't under the influence of drugs at the time of the accident and had only waited to get those out of their system |
