But however it does not mean you will always get to walk away in court. You could be charged with a lesser sentence.

Yes. Holding a gun to you is Assault With a Deadly Weapon. Even if they don't shoot you.

If the person who has you at gunpoint has identified him/herself as a law enforcement officer and is arresting you/telling you to put down your weapon/etc., then no you cannot claim self-defence.

Otherwise, if a reasonable person would view the situation as presenting imminent threat to one's life, then you may defend yourself.

Of course, isn't it common sense that you can defend yourself?

if you are not a cop or trained in that way i would say yes

if you are a cop, fbi etc etc
there are a different set of rules for those folk
they are taught how to diffuse the situation etc etc

If you think you can go to where your gun is (because carrying a gun is pretty much illegal anymore, unless you have a concealed gun permit), while he waits, unlock the trigger (cause everyone knows a responsible person has a locking trigger guard) and then shoot him. Of course this could take as much as a minute or two. If he hasn't shot you by then, he probably won't. Then it be a lot harder to say it's self defense. My question is this: what do you have a gun in your hand for anyway? THAT's the ONLY way you could shoot someone BEFORE he shoots you. And HE probably is thinking that it's self defense. You would have to give a LOT more details on the situation.

On your property , yes self defence. However you would have to prove it that you had a gun pointed to your head, we all could go and kill someone and just say that they had a gun on me, THATS NOT GONNA WORK

Wait a minute... so... you both have guns at each other... in which case whoever pulled the trigger would be the criminal... so... I'm gonna say no. Unless it's in your own home I suppose, that might be defense. But chances are if a guy comes up to you on the street and holds you up you'd be too surprised to whip out your own gun, or too slow since he's already got his on you.
