please help i need to know REALLY soon
Additional Details
first of all.... im not the one in trouble it is my freind and i am trying to help him he has a baby due in 16 days and if he doesnt claim it the mom is giving it up because she doesnt want it and he has no one to sign away his rights to. but ok the felony probation was for atempted murder, he got the probation from a plee bargain and something else im not really sure. Last night i left my house at 2 in the morning and somehow my father found me, the guy i am discussing is 24 i am only 16, my father decided to press charges even though i am telling him nothing happened. I was just hoping there would be a way to get him out of all of this isnt there something i can do?

yes anything will violate you even a parking ticket there very strick and now someone is pressing charges against him that for sure will violate him it all depends too i mean if ur father drops the charges they could let it go but the state usually picks it up so im sorry but for what he is on probation for there not gonna just let that go getting out with probation on a attemted murder was pretty lucky and sometimes they just look for anything to violate you trust me i was in the system for about 3 years i know how they work and that was only just mistominmer probatetion for something completly stupid but i was violated a few times for silly stuff

In most cases the conditions of probation would include a condition that you can not violate any law. If you have been charged in a new case, regardless of the nature, your probation officer could bring an action that would put you in violation of your probation. Every state has different procedures when this happens but generally you will be afforded some type of a "hearing" which could be in front of another probation officer or any other official that your state has established as the proper authority to hear such matters. If you were to disagree with the decision there would be a means for you to go before the judge that placed you on probation. Without knowing the history of the jurisdiction in which you are on probation it is only a guess if you are going to be "violated". It would be a really good idea if you contacted your probation officer before he/she learns about the matter from some other source. You may be able to convince them of the minor nature of your involvement (if that is the case). If you do contact them and they were planning on violating you anyway you have not lost anything.

If you committed any new crime they can violate, or revoke your probation. It doesn't have to be the same nature of a crime. You needed help before you acquired the new charges. Don't do the crime if you can't do the time. Next time ask us before you violate your probation.
That makes it even worst, he attempted to kill somebody, he has some girl pregnant and he is now 24 messing with a 16 year old while he already has a baby on the way, while already on felony probation. We will excuse you since you don't know any better. He deserves to be back in prison, no sympathy from me.

yeah. i know any run in at all with the law is a violation of my parole even if i don't get charged with anything. if i'm at a party and cops show up, i'm hit. so i'm pretty sure you are too dude, sorry.

nothing
At least it was only attempted murder. That's not too bad.

sikn_shadow_420
actually if your above the legal age of consent in your state he's safe, your dad is pissed, but can't really do anything about it.

but, i recomend you make better "friends".

p.s go to the link and rerify for your state, its usually 16 but there are exeptions, the link is a gay rights site, but the laws don't change because of that.

p.p.s. i'm not gay, i just googled and this site poped up, lol.

Yes. Your probation states you have to obey *ALL* laws, and have no police contact.

Maybe when you're in prison you can take some ENGLISH classes.

If he gets charged with anything then it would violate his probation, however if you have not done anything with him then go to a doctor and prove it. That would only be helpful to you if youre still a virgin though...
You will have to show, to your parents and a court that there was not anything going on...
good luck with that
It would be a good idea to get your friend to call his probation officer and maybe get an attorney.

Probably, since your probation papers should have something in them that says you will refrain from breaking any other laws or you will be found to be in violation.

hdbambi
Yes. If you commit any crime while on probation, you are violation your probation.

MikeInRI
Most likely you would still be in violation of your probation - but that is not necessarily the case - what does it say in your probation?

deputeesteph33

It does not matter. If you are on probation and do anything wrong then you are in trouble. Get a attorney fast.

'Barn
Depends on the stipulation of your probation. I strongly suggest ou speak to your probation officer right away.

I believe it states on your probabtion "involved in any crime or wrong doing?"
I would say "YES"

LazlaHollyfeld
I believe you'd have to be *convicted* of the second charge, not just charged, but almost any violation of the law can be a parole or probation violation. Contact your PO to be certain.
