If you are a swat officer are you legally allowed to personally own guns unattainable for citizens?

No, you are not. As a police officer (including SWAT) you are not allowed to personally own any weapon that the general public could not own, such as any fully automatic weapon. This does not mean that you could not be issued it and/or use it in your line of work, but you would not own it. It would still belong to the department and to take it out for personal use could land you in some serious hot water.

Also, as to what Moe said. He is incorrect when he states that it is a $200/year tax stamp for class 3 weapons. It is actually only a one time $200 tax stamp from the federal government. You only have to pay it once and never again. However, when and if the machine gun, suppressor, or short barreled firearm is transferred again, there must be a new $200 tax stamp purchased. Again, this is only if the weapon is transferred. The $200 tax stamp DOES NOT need to be paid yearly.

Of course you can own select-fire weapons and sound suppressors whether you're SWAT or not. You are first processed through your local police chief or sheriff and submit two sets of fingerprints to the BATF and FBI and pay $200.00 to the US Treasury for a tax stamp one time for each item to be approved and registered. This is the National Firearms Act that has been the law since 1934. Any unregistered machinegun has been illegally converted,stolen,manufactured or imported and carries with it a mandatory 10 year federal prison sentence.

It probably varies by jurisdiction. I live in California, where most ordinary citizens can't have machine guns. I've encountered one Sheriff's deputy who owns a submachine gun. He even let me fire it.

You do not have to be " SWAT " to own the types of firearms that your asking about. Alot of states allow weapons such as HK MP5's M-16's silencers and other items such as this. These firearms can be bought though a class III dealer if you have a clean record and get approved through the ATF, which can be done. when a person buys full auto's or short barrel rifles, machine pistols and such there is a $200 tax each year for such firearms. Silencers and supressors are a different $200 per year. So yes a swat officer can own these types of firearms legally just like you can if he meets the requirements from the ATF and pays the taxes just like you......
