If you are the passenger and are 21 or above, but your driver who is also 21 or above gets a DWI, do you go to jail too or get charged also with aiding and abbedding? North Carolina would be prefered! Thanks!

No, you won't go to jail unless you too have also been drinking. If that's the case you can be arrested for Public Intoxication. Otherwise you will be able to go on your way and probably be able to drive your friends' car away. |

No! If you are a licensed driver, then they can have you drive the car home. They can also make you walk home or give you a ride (YEAH RIGHT) to a safe location.
Legally, you have no way of being held responsible for some one else drinking and driving! |

how bout you be a man, say no D.D. no drive! its not hard, for real man, someones mom, dad, son, daughter, family, friends etc...are on that roadway. stop being a moron about drinking, if someone is drunk. DONT ALLOW THEM TO DRIVE! and if your intoxacted, you go to jail as well. i dont think you even have to be intoxacted, just stupid. i think if your stupid enough to say i dont care about other peoples lives, you should get the book thrown at you.
sad thing is, most of the time the drunk lives, with no major injurys.. |

There is a town near me where they will arrest the passenger for public intoxication if the passenger is drunk. If the passenger has not been drinking, he or she cannot be charged with anything. A passenger is not legally responsible for the actions of the driver. |
