Yes you do have to tell them your name. Obviously not telling them your name will arouse suspicion!

EVERYONE is obligated under law to identify themselves to a police officer. For no reason what so ever. They ask, you MUST tell. Anyone over 18 without government issued photo id can be detained for the purposes of identification, even if they have not committed any crime. |

I don't know about UK, but here in US, if you don't give your name you are just asking for trouble.
If you don't give your name, you must have something you don't want them to know about you.
This will cause them to detain you further. |

No, you don't have to give your name (contrary to what most people have said above). There is no legal obligation in UK whatsoever to give your name to police if you are just randomly stopped. However, if you're driving a car, Road Traffic Act means you do have to. |

By refusing any questions, you are saying you hav something to hide. |

Yes, it's illegal to lie to the police about your name and address. |

In the U.S. you must comply with an officer and produce and I.D. |

If they have a reason to stop you they should explain the grounds for the stop. Ask them why you are being stopped and ask for a copy of the stop form. If there are grounds to stop and/or search you then you will need to give your name |

UK Police can ask for your name and address at any time.
If you have nothing to hide, you just tell them.
If you do have something to hide, tell them you are an illegal immigrant and they will direct you to the illegal immigrants' reception centre at Croydon, and leave you to make your own way there. |

You must be joking, my friend. I never see them through the day, let alone at night ! |

Don't think you have to really unless you've committed an offence but prob make it easier for yourself if you just tell them. |

you have to tell them, they might be trying to find a criminal or just making sure you are ok |
|

Seen it all before

why wouldn't you?
i suppose it depends on how forceful your refusal is.....is your right to refuse worth getting arrested over? |

The police have a right to ask your name and personal details, failure to supply them will result in arrest. |

Yes you have to tell them. Why wouldn't you? What would be the point in refusing unless you're doing something you shouldn't be. |

You have to tell them or be charged with obstructing the Police.
Why argue if you have nothing to hide. |

If you have nothing to conceal, just answer the Officers' questions, and, you shall soon be on your way home. |

Yes it is. Just tell them you dont have nothing to be scared off. |

If you were drunk and alone - I'd guess they were trying to help - because that would make you a vulnerable target! Too many people go missing on their way home alone after a night out! |

Yes you do |

I read PACE last year and I have forgotten most of it but from what I can remember they have to have reasonable suspicion to arrest you, although I think they can arrest you if they suspect you have given them a false name. If you don't have to say anything or it will get taken down, then I don't see why you have to speak to give your name. I'm a rubbish law student as I spend too much time talking about nonsense on yahoo. |

I'm in the U.S and the other day I was in court and the judge said it is illegal for a cop to stop and ask 4 identification without probable cause

If police say. Why don't you answer the question, if you have nothing to hide. Reply: As it happens i am hiding my privacy, protecting my freedom. It is a free country. So they say. |
