jail - they aren't a taxi service and cant release you to population because then it is public intoxication which is a crime. |

Here in Ontario, you will be brought to the station for a breathalyser and depending on you record and level on intoxication, either can happen.
If you are really drunk and there is no one who can come and get you at the station, or no one to keep an eye on you at home, we will keep you until sober and release you with papers compelling you to court at a later date.
If you aren't too drunk and your record isn't bad we will release you from the station with paper compelling you to court.
If you have an extensive record, or a record for failing to appear for court, you will be held for a bail hearing. |

In Illinois, traffic laws have no juvenile - adult separation. So a 16 yo can be arrested for DUI and jailed as an adult. So your answer is jail. |

It depends where you get stopped. In most places you will be arrested and taken to jail; however, in some small towns, where the sheriff/police know everyone, you may just be driven home.
Why risk it, do not drink and drive, take a cab, the bus, a designated driver, walk. You have a one in three chance of making it home safely (1. arrive home with no problems; 2. get pulled over and arrested; 3. get into an accident and then arrested) so why risk it ? |

One night I was drunk as a skunk when the police pulled me over. They knew it and I knew that they knew it. But I passed the Field Sobriety tests (yes, when you're used to walking on a ship at sea, it's pretty easy.) They didn't have breathalyzers back then, or it would have been a whole different story.
They did ticket me for having an open container in my vehicle but that wasn't an arrestable offense. But they couldn't allow me to drive, either. So they had me lock the car and drove me home. Like I was gonna argue? Can we say... FRICKIN' LUCKY??? |
