I'm just curiuos so don't think this actually happend. (For all you retards out there not trying to be mean but there are some messed up people on this site). So would you be charged with murder after all you did brake a law witch was speeding. But the crash was not on purpose.

If this does happen you will be charged with vehicular homicide and spend time in jail. The time in jail is between 10 to 20 years.

It first depends on the conditions and the speed the car was traveling at. In most cases the driver would be charged with reckless driving and endangerment. Also and more importantly the driver would be charged with vehicular manslaughter and it carries anywhere from probation to 5 years in prison depending on the degree of the accident and the carelessness of the driver.

If you kill the person in the crash, you should be charged with involuntery man slaughter. You are not God, you have no say when it is time for a person to leave this world

I love my deer
i guess you could get charged but then again you could just get a speedin ticket and be depressed all your life 4 killin a person.

It deppends on several things. Was the driver drunk? If so than it could be charged as a Felonly, If they have certain restrictions on their DL such as : driving while takeing cretain meds, certain times of the day or certain motor vechicles. In cases like that they could be charged with something.

Murder is with intent - vehicular manslaughter would most likely be the charge

Probably not unless there are factors that could be proven to be depraved indifference to the loss of human life. Most likely the driver would be charged with some degree of manslaughter, which is just as serious.

NO... not until proven by thurough investigation.

It wouldn't be murder unless you were speeding to intentionally kill the person...and even then it could be plead down to manslaughter (unless the driver has a record of doing that sort of thing in the past) At best it would be a manslaughter charge.

papa bear
i believe its called-----vehicular manslaughter..... basically the same as murder.......

I believe it depends upon the state you live in. In some states an individual can be charged with involuntary manslaughter. This has happened in Washington State several times.

Since the driver was breaking the law by speeding, he or she could be charged with Vehicular Homicide. The driver would definitely be charged with something because they knowingly drove recklessly and put another person's life at risk.

Not trying to me mean...really..
But there is a crap load of DA's working on any easy case to boost their marks that will try and charge you with BS just to see if you will take probation...

not murder, but manslaughter would prob depend on if they could prove you were speeding, were drunk. etc.

todieisgain_121
If that happened, and it truely was an accident, then nothing would happen. If you were speeding, or driving unsafely, they may charge you with manslaughter.

yeah i think you can but if not they'll get u for speeding but i think u can go to jail

in Nevada yes, a new law was just passed stating that if you are the driver in any fatal accident, whether it is your passenger that is hurt or not you will be charged with either Manslaughter, Involuntary Manslaughter, or Vehicular Manslaughter.

Depending on the nature of the incident.

involuntary manslaughter

Perkins
Not murder, as they would have to prove intent.

You would probably be charged with manslaughter

It could turn out that way.

It's more likely you'd be charged with involuntary manslaughter. I believe one of the definitions of murder is "with the intent to kill."

Kelly K
I'm thinking more like "Involuntary Manslaughter"
