It first depends on the conditions and the speed the car was traveling at. In most cases the driver would be charged with reckless driving and endangerment. Also and more importantly the driver would be charged with vehicular manslaughter and it carries anywhere from probation to 5 years in prison depending on the degree of the accident and the carelessness of the driver. |

It deppends on several things. Was the driver drunk? If so than it could be charged as a Felonly, If they have certain restrictions on their DL such as : driving while takeing cretain meds, certain times of the day or certain motor vechicles. In cases like that they could be charged with something. |

It wouldn't be murder unless you were speeding to intentionally kill the person...and even then it could be plead down to manslaughter (unless the driver has a record of doing that sort of thing in the past) At best it would be a manslaughter charge. |

I believe it depends upon the state you live in. In some states an individual can be charged with involuntary manslaughter. This has happened in Washington State several times. |

Since the driver was breaking the law by speeding, he or she could be charged with Vehicular Homicide. The driver would definitely be charged with something because they knowingly drove recklessly and put another person's life at risk. |

If that happened, and it truely was an accident, then nothing would happen. If you were speeding, or driving unsafely, they may charge you with manslaughter. |

in Nevada yes, a new law was just passed stating that if you are the driver in any fatal accident, whether it is your passenger that is hurt or not you will be charged with either Manslaughter, Involuntary Manslaughter, or Vehicular Manslaughter.
