Important question. I got charged with a knife and there was no fingerprints ?

they charged me today with no fingerprints and no evidence.
i did not know it was in my bag honestly
but they did not belive me and made me guilty
is there anyway i can appeal against this ?
i think it was tottaly unfair plus the cps did not belive me from the start ?

but they have charged me with it because they SAID
i knew it was in my bag
and i knew it was mine
but IT WASNT im so annoyed

If it's in your bag, it's in your possession.
If it's in your possession, you're in trouble.

That's common sense.

It DOES NOT matter that you did not know it was there.
If the court starts taking your word on that, imagine how many criminals will get away with crimes.

Why do you think they should assume you didn't know it was there?
Why should there need to be fingerprints when you were in possession of it?

I know you're mad about this situation. But imagine somebody stabbed one of your loved ones to death.
The police find them with a knife that matches up exactly with the stab wounds.
But there are no fingerprints.....And they're claiming that they didn't know it was in their bag.
Would you, as a loved one to the victim, agree that the knife should be used as evidence?

It's an offence to carry a knife. You had a bag with a knife in it. That is all the evidence they need. Where were you when they stopped you? Have you been charged with anything prior to this? Can you give them any proof of who it does belong to and how it got in your bag? If you were guilty, you would probably say you weren't so they will only act on evidence.

As someone else mentioned, they charged you with the offence, they did not find you guilty. That is up to the Judge.
Having it in your possession is more than enough to lay the charge. They do not have to prove you knew it was there.
Your defense can be that you did not know it was there. You have to come up with a reasonable, believable excuse why it was in there without your knowledge.
They also do not have to fingerprint the knife to prove their case. It is not like CSI.
It is not hard to believe why they didn't believe you, it was in YOUR bag. Honestly, Police hear "that's not mine" ALL the time. Anyone ever caught in possession of something has said that. You cant blame them for not believing. If you are the odd person who it really didn't know, then that is what court is for, to prove it.

They "charged" you . . . they did not convict you.

Ask for a trial . . . . hire a GOOD attorney . . .

Since the knife "isn't yours" then there is no record of you buying a knife . . . like that . . . . from a local store or over the internet.

If they cannot reconstruct possession and prove you knowingly possessed the knife, then they have no case. That is the point of law on these matters. This can also be done by proving you knew it was in the bag. In other words there are numerous other ways to prove possession without fingerprints. People watch too much CSI and get the impression scientific evidence is the only real evidence. Hire a lawyer to monitor things.
